44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a study by the General Land Office regarding the
77 feasibility of creating a mechanism by which a governmental entity
88 could acquire small parcels of real property in an area and convey
99 them to a developer in order to ensure the property is developed in
1010 compliance with model subdivision rules.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) The General Land Office shall conduct a
1313 study of the feasibility of establishing a mechanism by which a
1414 governmental entity could:
1515 (1) acquire contiguous small parcels of real property
1616 that have nominal value;
1717 (2) combine the properties in a manner that makes the
1818 properties marketable for development; and
1919 (3) convey the properties to a developer for
2020 development of the property in a manner that complies with
2121 standards prescribed by model subdivision rules adopted under
2222 Section 16.343, Water Code.
2323 (b) The study conducted under this section must:
2424 (1) establish methods for identifying property
2525 suitable for acquisition;
2626 (2) establish methods for identifying owners of
2727 property considered suitable for acquisition;
2828 (3) identify appropriate methods of acquiring,
2929 holding title to, and conveying the property and include an
3030 analysis of the appropriateness of acquiring the property;
3131 (4) identify appropriate methods of compensating the
3232 owners of the property acquired;
3333 (5) identify any appropriate land use or development
3434 requirements or restrictions for the property; and
3535 (6) identify any legislative action necessary to
3636 facilitate the establishment of a mechanism described by this
3737 section.
3838 (c) Not later than December 1, 2016, the General Land Office
3939 shall provide to the legislature a report containing the results of
4040 the study conducted under this section.
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2015.
