| 6 | 6 | | relating to a study by the General Land Office regarding the |
|---|
| 7 | 7 | | feasibility of creating a mechanism by which a governmental entity |
|---|
| 8 | 8 | | could acquire small parcels of real property in an area and convey |
|---|
| 9 | 9 | | them to a developer in order to ensure the property is developed in |
|---|
| 10 | 10 | | compliance with model subdivision rules. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. (a) The General Land Office shall conduct a |
|---|
| 13 | 13 | | study of the feasibility of establishing a mechanism by which a |
|---|
| 14 | 14 | | governmental entity could: |
|---|
| 15 | 15 | | (1) acquire contiguous small parcels of real property |
|---|
| 16 | 16 | | that have nominal value; |
|---|
| 17 | 17 | | (2) combine the properties in a manner that makes the |
|---|
| 18 | 18 | | properties marketable for development; and |
|---|
| 19 | 19 | | (3) convey the properties to a developer for |
|---|
| 20 | 20 | | development of the property in a manner that complies with |
|---|
| 21 | 21 | | standards prescribed by model subdivision rules adopted under |
|---|
| 22 | 22 | | Section 16.343, Water Code. |
|---|
| 23 | 23 | | (b) The study conducted under this section must: |
|---|
| 24 | 24 | | (1) establish methods for identifying property |
|---|
| 25 | 25 | | suitable for acquisition; |
|---|
| 26 | 26 | | (2) establish methods for identifying owners of |
|---|
| 27 | 27 | | property considered suitable for acquisition; |
|---|
| 28 | 28 | | (3) identify appropriate methods of acquiring, |
|---|
| 29 | 29 | | holding title to, and conveying the property and include an |
|---|
| 30 | 30 | | analysis of the appropriateness of acquiring the property; |
|---|
| 31 | 31 | | (4) identify appropriate methods of compensating the |
|---|
| 32 | 32 | | owners of the property acquired; |
|---|
| 33 | 33 | | (5) identify any appropriate land use or development |
|---|
| 34 | 34 | | requirements or restrictions for the property; and |
|---|
| 35 | 35 | | (6) identify any legislative action necessary to |
|---|
| 36 | 36 | | facilitate the establishment of a mechanism described by this |
|---|
| 37 | 37 | | section. |
|---|
| 38 | 38 | | (c) Not later than December 1, 2016, the General Land Office |
|---|
| 39 | 39 | | shall provide to the legislature a report containing the results of |
|---|
| 40 | 40 | | the study conducted under this section. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2015. |
