| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 372, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 372.002 to read as follows: |

| 12 | 12 | | Sec. 372.002. FINANCIAL STUDIES AND REPORTS SUBJECT TO |
|---|
| 13 | 13 | | DISCLOSURE. (a) Financial studies and reports associated with an |
|---|
| 14 | 14 | | existing or proposed toll project, including financial forecasts, |
|---|
| 15 | 15 | | traffic and revenue reports, and other information gathered and |
|---|
| 16 | 16 | | used to support the feasibility of a toll project, are subject to |
|---|
| 17 | 17 | | disclosure, inspection, and copying under Chapter 552, Government |
|---|
| 18 | 18 | | Code. |
|---|
| 19 | 19 | | (b) Notwithstanding Sections 223.204(a), 366.403(a), and |
|---|
| 20 | 20 | | 370.307(a), this section applies to financial studies and reports |
|---|
| 21 | 21 | | associated with a proposed toll project, regardless of whether a |
|---|
| 22 | 22 | | final contract for the project has been entered into. |
|---|
| 23 | 23 | | SECTION 2. Section 371.052(d), Transportation Code, is |
|---|
| 24 | 24 | | repealed. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2015. |
