97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. The heading to Subchapter P, Chapter 623,
119 Transportation Code, is amended to read as follows:
1210 SUBCHAPTER P. PORT OF CORPUS CHRISTI AUTHORITY [SPECIAL FREIGHT
1311 CORRIDOR] PERMITS
1412 SECTION 2. Section 623.301, Transportation Code, is amended
1513 to read as follows:
1614 Sec. 623.301. OPTIONAL PROCEDURE. This subchapter provides
1715 an optional procedure for the issuance of a permit by the Port of
1816 Corpus Christi Authority for the movement of oversize or overweight
1917 vehicles carrying cargo on certain roads [a state highway special
2018 freight corridor] located in San Patricio and Nueces Counties
2119 [County].
2220 SECTION 3. Section 623.302, Transportation Code, is amended
2321 to read as follows:
2422 Sec. 623.302. DEFINITION [DEFINITIONS]. In this
2523 subchapter, "port[:
2624 [(1) "Port] authority" means the Port of Corpus
2725 Christi Authority[; and
2826 [(2) "Special freight corridor" means a highway built
2927 by this state specifically for the movement of oversize or
3028 overweight vehicles carrying cargo in San Patricio County to and
3129 from the port authority's La Quinta terminal].
3230 SECTION 4. Section 623.303, Transportation Code, is amended
3331 to read as follows:
3432 Sec. 623.303. ISSUANCE OF PERMITS. (a) The Texas
3533 Transportation Commission may authorize the port authority to issue
3634 permits for the movement of oversize or overweight vehicles
3735 carrying cargo [on state highway special freight corridors located]
3836 in San Patricio and Nueces Counties on:
3937 (1) the following roads:
4038 (A) U.S. Highway 181 between its intersection
4139 with Burleson Street in the city of Corpus Christi and its
4240 intersection with County Road 3567 (Midway Road) in San Patricio
4341 County;
4442 (B) State Highway 35 between its intersection
4543 with Burleson Street in the city of Corpus Christi and its
4644 intersection with Farm-to-Market Road 3512;
4745 (C) State Highway 361 between its intersection
4846 with State Highway 35 and its intersection with Farm-to-Market Road
4947 1069 (Main Street) in the city of Ingleside; and
5048 (D) proposed State Highway 200 between its
5149 intersection with State Highway 361 and its intersection with
5250 Farm-to-Market Road 1069 (Main Street) in the city of Ingleside, if
5351 proposed State Highway 200 is constructed; or
5452 (2) another route designated by the commission in
5553 consultation with the authority [County].
5654 (b) The port authority may issue a permit under this
5755 subchapter only if the cargo being transported weighs 125,000
5856 pounds or less.
5957 SECTION 5. Section 623.306(a), Transportation Code, is
6058 amended to read as follows:
6159 (a) A permit issued under this subchapter must include:
6260 (1) the name of the applicant;
6361 (2) the date of issuance;
6462 (3) the signature of the manager of transportation of
6563 the port authority;
6664 (4) a statement of the kind of cargo being
6765 transported, the maximum weight and dimensions of the equipment,
6866 and the kind and weight of each commodity to be transported;
6967 (5) a statement of any condition on which the permit is
7068 issued;
7169 (6) a statement that the cargo may [only] be
7270 transported in San Patricio and Nueces Counties only over the roads
7371 described by or designated under Section 623.303 [to and from the
7472 port authority's La Quinta terminal in San Patricio County using a
7573 state highway special freight corridor in San Patricio County]; and
7674 (7) the location where the cargo was loaded.
7775 SECTION 6. This Act takes effect immediately if it receives
7876 a vote of two-thirds of all the members elected to each house, as
7977 provided by Section 39, Article III, Texas Constitution. If this
8078 Act does not receive the vote necessary for immediate effect, this
8179 Act takes effect September 1, 2015.
