7	5		relating to the issuance of certain permits for the movement of
8	6		oversize or overweight vehicles.
9	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	8		SECTION 1. The heading to Subchapter P, Chapter 623,
11	9		Transportation Code, is amended to read as follows:
12	10		SUBCHAPTER P. PORT OF CORPUS CHRISTI AUTHORITY [SPECIAL FREIGHT
13	11		CORRIDOR] PERMITS
14	12		SECTION 2. Section 623.301, Transportation Code, is amended
15	13		to read as follows:
16	14		Sec. 623.301. OPTIONAL PROCEDURE. This subchapter provides
17	15		an optional procedure for the issuance of a permit by the Port of
18	16		Corpus Christi Authority for the movement of oversize or overweight
19	17		vehicles carrying cargo on certain roads [a state highway special
20	18		freight corridor] located in San Patricio and Nueces Counties
21	19		[County].
22	20		SECTION 3. Section 623.302, Transportation Code, is amended
23	21		to read as follows:
24	22		Sec. 623.302. DEFINITION [DEFINITIONS]. In this
25	23		subchapter, "port[:
26	24		[(1) "Port] authority" means the Port of Corpus
27	25		Christi Authority[; and
28	26		[(2) "Special freight corridor" means a highway built
29	27		by this state specifically for the movement of oversize or
30	28		overweight vehicles carrying cargo in San Patricio County to and
31	29		from the port authority's La Quinta terminal].
32	30		SECTION 4. Section 623.303, Transportation Code, is amended
33	31		to read as follows:
34	32		Sec. 623.303. ISSUANCE OF PERMITS. (a) The Texas
35	33		Transportation Commission may authorize the port authority to issue
36	34		permits for the movement of oversize or overweight vehicles
37	35		carrying cargo [on state highway special freight corridors located]
38	36		in San Patricio and Nueces Counties on:
39	37		(1) the following roads:
40	38		(A) U.S. Highway 181 between its intersection
41	39		with Burleson Street in the city of Corpus Christi and its
42	40		intersection with County Road 3567 (Midway Road) in San Patricio
43	41		County;
44	42		(B) State Highway 35 between its intersection
45	43		with Burleson Street in the city of Corpus Christi and its
46	44		intersection with Farm-to-Market Road 3512;
47	45		(C) State Highway 361 between its intersection
48	46		with State Highway 35 and its intersection with Farm-to-Market Road
49	47		1069 (Main Street) in the city of Ingleside; and
50	48		(D) proposed State Highway 200 between its
51	49		intersection with State Highway 361 and its intersection with
52	50		Farm-to-Market Road 1069 (Main Street) in the city of Ingleside, if
53	51		proposed State Highway 200 is constructed; or
54	52		(2) another route designated by the commission in
55	53		consultation with the authority [County].
56	54		(b) The port authority may issue a permit under this
57	55		subchapter only if the cargo being transported weighs 125,000
58	56		pounds or less.
59	57		SECTION 5. Section 623.306(a), Transportation Code, is
60	58		amended to read as follows:
61	59		(a) A permit issued under this subchapter must include:
62	60		(1) the name of the applicant;
63	61		(2) the date of issuance;
64	62		(3) the signature of the manager of transportation of
65	63		the port authority;
66	64		(4) a statement of the kind of cargo being
67	65		transported, the maximum weight and dimensions of the equipment,
68	66		and the kind and weight of each commodity to be transported;
69	67		(5) a statement of any condition on which the permit is
70	68		issued;
71	69		(6) a statement that the cargo may [only] be
72	70		transported in San Patricio and Nueces Counties only over the roads
73	71		described by or designated under Section 623.303 [to and from the
74	72		port authority's La Quinta terminal in San Patricio County using a
75	73		state highway special freight corridor in San Patricio County]; and
76	74		(7) the location where the cargo was loaded.
77	75		SECTION 6. This Act takes effect immediately if it receives
78	76		a vote of two-thirds of all the members elected to each house, as
79	77		provided by Section 39, Article III, Texas Constitution. If this
80	78		Act does not receive the vote necessary for immediate effect, this
81	79		Act takes effect September 1, 2015.
