97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Subtitle F, Title 2, Government Code, is amended
119 by adding Chapter 80 to read as follows:
1210 CHAPTER 80. DELIVERY OF NOTICE AND DOCUMENTS
1311 Sec. 80.001. DELIVERY OF NOTICE OR DOCUMENT. A court,
1412 justice, judge, magistrate, or clerk may send any notice or
1513 document by a method authorized by Section 80.002.
1614 Sec. 80.002. AUTHORIZED DELIVERY OF NOTICE OR DOCUMENT. A
1715 court, justice, judge, magistrate, or clerk may send any notice or
1816 document using mail or electronic mail. This section applies to all
1917 civil and criminal statutes requiring delivery of a notice or
2018 document.
2119 Sec. 80.003. ELECTRONIC MAIL ADDRESS. (a) If electronic
2220 mail is used to send a notice or document and the person who will
2321 receive the notice or document is registered with the electronic
2422 filing system established under Section 72.031, as added by Chapter
2523 1290 (H.B. 2302), Acts of the 83rd Legislature, Regular Session,
2624 2013, the court, justice, judge, magistrate, or clerk sending the
2725 notice or document must use the electronic mail address on file with
2826 the electronic filing system, if the court uses the electronic
2927 filing system.
3028 (b) If electronic mail is used to send a notice or document
3129 and the person who will receive the notice or document is not
3230 registered with the electronic filing system established under
3331 Section 72.031, as added by Chapter 1290 (H.B. 2302), Acts of the
3432 83rd Legislature, Regular Session, 2013, or the court does not use
3533 the electronic filing system, the court, justice, judge,
3634 magistrate, or clerk must use the electronic mail address provided
3735 by the person.
3836 Sec. 80.004. MAIL. (a) The definition of mail in this
3937 chapter includes:
4038 (1) first-class mail;
4139 (2) first-class United States mail;
4240 (3) ordinary or regular mail; and
4341 (4) international first-class mail.
4442 (b) The definition of mail in this chapter does not include:
4543 (1) any form of mail that requires proof of delivery;
4644 (2) certified mail;
4745 (3) certified mail or a comparable mailing method that
4846 provides proof of delivery;
4947 (4) certified mail, restricted delivery;
5048 (5) certified mail, return receipt requested;
5149 (6) delivery by the United States Postal Service using
5250 a signature confirmation service;
5351 (7) documents delivered by common or contract
5452 carriers, including Federal Express or United Parcel Service;
5553 (8) express mail offered by the United States Postal
5654 Service;
5755 (9) first-class mail, return receipt requested;
5856 (10) freight mail;
5957 (11) interagency mail;
6058 (12) international registered mail, return receipt
6159 requested;
6260 (13) mail, return receipt requested;
6361 (14) personal service or hand delivery;
6462 (15) prepaid registered mail;
6563 (16) registered mail;
6664 (17) registered mail, return receipt requested; and
6765 (18) certified or registered mail, restricted
6866 delivery, return receipt requested.
6967 Sec. 80.005. ELECTRONIC MAIL. (a) Authorized methods of
7068 delivering a notice or document by electronic mail include:
7169 (1) electronic notice sent through the electronic
7270 filing system under Section 72.031, as added by Chapter 1290 (H.B.
7371 2302), Acts of the 83rd Legislature, Regular Session, 2013;
7472 (2) electronic notice;
7573 (3) electronic mail messages;
7674 (4) e-mail; and
7775 (5) secure electronic mail.
7876 (b) Authorized methods of delivering a notice or document by
7977 electronic mail do not include:
8078 (1) facsimiles;
8179 (2) instant messaging;
8280 (3) messages on a social network website, including
8381 Facebook and Twitter;
8482 (4) telegraphs;
8583 (5) telephone messages;
8684 (6) text messages;
8785 (7) videoconferencing;
8886 (8) voice messages; or
8987 (9) webcams.
9088 SECTION 2. This Act takes effect September 1, 2015.
