66 relating to the creation of the Brazoria County Municipal Utility
77 District No. 68; granting a limited power of eminent domain;
88 providing authority to issue bonds; providing authority to impose
99 assessments, fees, or taxes.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8493 to read as follows:
1313 CHAPTER 8493. BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO. 68
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8493.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Commission" means the Texas Commission on
1818 Environmental Quality.
1919 (3) "Director" means a board member.
2020 (4) "District" means the Brazoria County Municipal
2121 Utility District No. 68.
2222 Sec. 8493.002. NATURE OF DISTRICT. The district is a
2323 municipal utility district created under Section 59, Article XVI,
2424 Texas Constitution.
2525 Sec. 8493.003. CONFIRMATION AND DIRECTORS' ELECTION
2626 REQUIRED. The temporary directors shall hold an election to
2727 confirm the creation of the district and to elect five permanent
2828 directors as provided by Section 49.102, Water Code.
2929 Sec. 8493.004. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3030 The district is created to serve a public purpose and benefit.
3131 (b) The district is created to accomplish the purposes of:
3232 (1) a municipal utility district as provided by
3333 general law and Section 59, Article XVI, Texas Constitution; and
3434 (2) Section 52, Article III, Texas Constitution, that
3535 relate to the construction, acquisition, improvement, operation,
3636 or maintenance of macadamized, graveled, or paved roads, or
3737 improvements, including storm drainage, in aid of those roads.
3838 Sec. 8493.005. INITIAL DISTRICT TERRITORY. (a) The
3939 district is initially composed of the territory described by
4040 Section 2 of the Act enacting this chapter.
4141 (b) The boundaries and field notes contained in Section 2 of
4242 the Act enacting this chapter form a closure. A mistake made in the
4343 field notes or in copying the field notes in the legislative process
4444 does not affect the district's:
4545 (1) organization, existence, or validity;
4646 (2) right to issue any type of bond for the purposes
4747 for which the district is created or to pay the principal of and
4848 interest on a bond;
4949 (3) right to impose a tax; or
5050 (4) legality or operation.
5151 Sec. 8493.006. CONSENT OF MUNICIPALITY. Municipal consent
5252 to the creation of the district acts as municipal consent to the
5353 creation of any new district created by the division of the district
5454 under Section 8493.107.
5555 SUBCHAPTER B. BOARD OF DIRECTORS
5656 Sec. 8493.051. GOVERNING BODY; TERMS. (a) The district is
5757 governed by a board of five elected directors.
5858 (b) Except as provided by Section 8493.052, directors serve
5959 staggered four-year terms.
6060 Sec. 8493.052. TEMPORARY DIRECTORS. (a) On or after the
6161 effective date of the Act enacting this chapter, the owner or owners
6262 of a majority of the assessed value of the real property in the
6363 district may submit a petition to the commission requesting that
6464 the commission appoint as temporary directors the five persons
6565 named in the petition. The commission shall appoint as temporary
6666 directors the five persons named in the petition.
6767 (b) Temporary directors serve until the earlier of:
6868 (1) the date permanent directors are elected under
6969 Section 8493.003; or
7070 (2) the fourth anniversary of the effective date of
7171 the Act enacting this chapter.
7272 (c) If permanent directors have not been elected under
7373 Section 8493.003 and the terms of the temporary directors have
7474 expired, successor temporary directors shall be appointed or
7575 reappointed as provided by Subsection (d) to serve terms that
7676 expire on the earlier of:
7777 (1) the date permanent directors are elected under
7878 Section 8493.003; or
7979 (2) the fourth anniversary of the date of the
8080 appointment or reappointment.
8181 (d) If Subsection (c) applies, the owner or owners of a
8282 majority of the assessed value of the real property in the district
8383 may submit a petition to the commission requesting that the
8484 commission appoint as successor temporary directors the five
8585 persons named in the petition. The commission shall appoint as
8686 successor temporary directors the five persons named in the
8787 petition.
8888 SUBCHAPTER C. POWERS AND DUTIES
8989 Sec. 8493.101. GENERAL POWERS AND DUTIES. The district has
9090 the powers and duties necessary to accomplish the purposes for
9191 which the district is created.
9292 Sec. 8493.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9393 DUTIES. The district has the powers and duties provided by the
9494 general law of this state, including Chapters 49 and 54, Water Code,
9595 applicable to municipal utility districts created under Section 59,
9696 Article XVI, Texas Constitution.
9797 Sec. 8493.103. LEVEE IMPROVEMENT DISTRICT POWERS AND
9898 DUTIES. The district has the powers and duties provided by the
9999 general law of this state, including Chapter 57, Water Code,
100100 applicable to levee improvement districts created under Section 59,
101101 Article XVI, Texas Constitution.
102102 Sec. 8493.104. AUTHORITY FOR ROAD PROJECTS. Under Section
103103 52, Article III, Texas Constitution, the district may design,
104104 acquire, construct, finance, issue bonds for, improve, operate,
105105 maintain, and convey to this state, a county, or a municipality for
106106 operation and maintenance macadamized, graveled, or paved roads, or
107107 improvements, including storm drainage, in aid of those roads.
108108 Sec. 8493.105. ROAD STANDARDS AND REQUIREMENTS. (a) A road
109109 project must meet all applicable construction standards, zoning and
110110 subdivision requirements, and regulations of each municipality in
111111 whose corporate limits or extraterritorial jurisdiction the road
112112 project is located.
113113 (b) If a road project is not located in the corporate limits
114114 or extraterritorial jurisdiction of a municipality, the road
115115 project must meet all applicable construction standards,
116116 subdivision requirements, and regulations of each county in which
117117 the road project is located.
118118 (c) If the state will maintain and operate the road, the
119119 Texas Transportation Commission must approve the plans and
120120 specifications of the road project.
121121 Sec. 8493.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
122122 OR RESOLUTION. The district shall comply with all applicable
123123 requirements of any ordinance or resolution that is adopted under
124124 Section 54.016 or 54.0165, Water Code, and that consents to the
125125 creation of the district or to the inclusion of land in the
126126 district.
127127 Sec. 8493.107. DIVISION OF DISTRICT. (a) The district may
128128 be divided into two or more new districts only if:
129129 (1) the district has no outstanding bonded debt; and
130130 (2) the district is not imposing ad valorem taxes.
131131 (b) This chapter applies to any new district created by the
132132 division of the district, and a new district has all the powers and
133133 duties of the district.
134134 (c) Any new district created by the division of the district
135135 may not, at the time the new district is created, contain any land
136136 outside the area described by Section 2 of the Act creating this
137137 chapter.
138138 (d) The board, on its own motion or on receipt of a petition
139139 signed by the owner or owners of a majority of the assessed value of
140140 the real property in the district, may adopt an order dividing the
141141 district.
142142 (e) The board may adopt an order dividing the district
143143 before or after the date the board holds an election under Section
144144 8493.003 to confirm the creation of the district.
145145 (f) An order dividing the district shall:
146146 (1) name each new district;
147147 (2) include the metes and bounds description of the
148148 territory of each new district;
149149 (3) appoint temporary directors for each new district;
150150 and
151151 (4) provide for the division of assets and liabilities
152152 between or among the new districts.
153153 (g) On or before the 30th day after the date of adoption of
154154 an order dividing the district, the district shall file the order
155155 with the commission and record the order in the real property
156156 records of each county in which the district is located.
157157 (h) Any new district created by the division of the district
158158 shall hold a confirmation and directors' election as required by
159159 Section 8493.003.
160160 (i) If the creation of the new district is confirmed, the
161161 new district shall provide the election date and results to the
162162 commission.
163163 (j) Any new district created by the division of the district
164164 must hold an election as required by this chapter to obtain voter
165165 approval before the district may impose a maintenance tax or issue
166166 bonds payable wholly or partly from ad valorem taxes.
167167 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
168168 Sec. 8493.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
169169 district may issue, without an election, bonds and other
170170 obligations secured by:
171171 (1) revenue other than ad valorem taxes; or
172172 (2) contract payments described by Section 8493.153.
173173 (b) The district must hold an election in the manner
174174 provided by Chapters 49 and 54, Water Code, to obtain voter approval
175175 before the district may impose an ad valorem tax or issue bonds
176176 payable from ad valorem taxes.
177177 (c) The district may not issue bonds payable from ad valorem
178178 taxes to finance a road project unless the issuance is approved by a
179179 vote of a two-thirds majority of the district voters voting at an
180180 election held for that purpose.
181181 Sec. 8493.152. OPERATION AND MAINTENANCE TAX. (a) If
182182 authorized at an election held under Section 8493.151, the district
183183 may impose an operation and maintenance tax on taxable property in
184184 the district in accordance with Section 49.107, Water Code.
185185 (b) The board shall determine the tax rate. The rate may not
186186 exceed the rate approved at the election.
187187 Sec. 8493.153. CONTRACT TAXES. (a) In accordance with
188188 Section 49.108, Water Code, the district may impose a tax other than
189189 an operation and maintenance tax and use the revenue derived from
190190 the tax to make payments under a contract after the provisions of
191191 the contract have been approved by a majority of the district voters
192192 voting at an election held for that purpose.
193193 (b) A contract approved by the district voters may contain a
194194 provision stating that the contract may be modified or amended by
195195 the board without further voter approval.
196196 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
197197 Sec. 8493.201. AUTHORITY TO ISSUE BONDS AND OTHER
198198 OBLIGATIONS. The district may issue bonds or other obligations
199199 payable wholly or partly from ad valorem taxes, impact fees,
200200 revenue, contract payments, grants, or other district money, or any
201201 combination of those sources, to pay for any authorized district
202202 purpose.
203203 Sec. 8493.202. TAXES FOR BONDS. At the time the district
204204 issues bonds payable wholly or partly from ad valorem taxes, the
205205 board shall provide for the annual imposition of a continuing
206206 direct ad valorem tax, without limit as to rate or amount, while all
207207 or part of the bonds are outstanding as required and in the manner
208208 provided by Sections 54.601 and 54.602, Water Code.
209209 Sec. 8493.203. BONDS FOR ROAD PROJECTS. At the time of
210210 issuance, the total principal amount of bonds or other obligations
211211 issued or incurred to finance road projects and payable from ad
212212 valorem taxes may not exceed one-fourth of the assessed value of the
213213 real property in the district.
214214 SECTION 2. The Brazoria County Municipal Utility District
215215 No. 68 initially includes all the territory contained in the
216216 following area:
217217 5,440.64 acres of land, more or less, being part of the Sam T.
218218 Angier Survey, Abstract 7, part of the L.P. Ehrmann Survey No. 24,
219219 Abstract 521, all of the H.T. & B.R.R. Co. Survey No. 23, Abstract
220220 248, all of the L.P. Ehrmann Survey No. 22, Abstract 519, all of the
221221 H.T. & B.R.R. Co. Survey No. 25, Abstract 277, part of the L.P.
222222 Ehrmann Survey No. 18, Abstract 520, part of the Day Land and Cattle
223223 Company Survey, Abstract 602, part of the Hooper and Wade Survey
224224 No. 11, Abstract 433, part of the H.T. & B.R.R. Co. Survey No. 21,
225225 Abstract 247, part of the L.P. Ehrmann Survey No. 26, Abstract 522,
226226 part of the L.P. Ehrmann Survey No. 28, Abstract 523, all of the

419419 SECTION 3. (a) The legal notice of the intention to
420420 introduce this Act, setting forth the general substance of this
421421 Act, has been published as provided by law, and the notice and a
422422 copy of this Act have been furnished to all persons, agencies,
423423 officials, or entities to which they are required to be furnished
424424 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
425425 Government Code.
426426 (b) The governor, one of the required recipients, has
427427 submitted the notice and Act to the Texas Commission on
428428 Environmental Quality.
429429 (c) The Texas Commission on Environmental Quality has filed
430430 its recommendations relating to this Act with the governor, the
431431 lieutenant governor, and the speaker of the house of

433433 (d) All requirements of the constitution and laws of this
434434 state and the rules and procedures of the legislature with respect
435435 to the notice, introduction, and passage of this Act are fulfilled
436436 and accomplished.
437437 SECTION 4. (a) If this Act does not receive a two-thirds
438438 vote of all the members elected to each house, Subchapter C, Chapter
439439 8493, Special District Local Laws Code, as added by Section 1 of
440440 this Act, is amended by adding Section 8493.108 to read as follows:
441441 Sec. 8493.108. NO EMINENT DOMAIN POWER. The district may
442442 not exercise the power of eminent domain.
443443 (b) This section is not intended to be an expression of a
444444 legislative interpretation of the requirements of Section 17(c),
445445 Article I, Texas Constitution.
446446 SECTION 5. This Act takes effect immediately if it receives
447447 a vote of two-thirds of all the members elected to each house, as
448448 provided by Section 39, Article III, Texas Constitution. If this
449449 Act does not receive the vote necessary for immediate effect, this
450450 Act takes effect September 1, 2015.
