1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to leases and other agreements relating to real property
1414 entered into by certain hospital districts.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 281.050(b), Health and Safety Code, is
1717 amended to read as follows:
1818 (b) Notwithstanding any other law, the board may, with the
1919 approval of the commissioners court, enter into a lease, including
2020 a lease with an option to purchase, an installment purchase
2121 agreement, an installment sale agreement, or any other type of
2222 agreement that relates to real property considered appropriate by
2323 the board [undeveloped real property for not more than 50 years] to
2424 provide for the development, improvement, acquisition, or
2525 management of developed or undeveloped real property [and
2626 construction of facilities] designed to generate revenue for the
2727 financial benefit of the district. The board, directly or through a
2828 nonprofit corporation, may contract or enter into a joint venture
2929 with a public or private entity as necessary to enter into an
3030 agreement [a lease] under this subsection.
3131 SECTION 2. Section 281.0511, Health and Safety Code, is
3232 amended by adding Subsection (d) to read as follows:
3333 (d) Notwithstanding any other law, the board may, with the
3434 approval of the commissioners court at a meeting subject to Chapter
3535 551, Government Code, lease undeveloped or vacant real property for
3636 not more than 99 years to provide for the development and
3737 construction of facilities designed to generate revenue for the
3838 financial benefit of the district. The board, directly or through a
3939 nonprofit corporation, may contract or enter into a joint venture
4040 with a public or private entity as necessary to enter into a lease
4141 under this subsection.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2015.
