| 15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Section 281.050(b), Health and Safety Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (b) Notwithstanding any other law, the board may, with the |
|---|
| 19 | 19 | | approval of the commissioners court, enter into a lease, including |
|---|
| 20 | 20 | | a lease with an option to purchase, an installment purchase |
|---|
| 21 | 21 | | agreement, an installment sale agreement, or any other type of |
|---|
| 22 | 22 | | agreement that relates to real property considered appropriate by |
|---|
| 23 | 23 | | the board [undeveloped real property for not more than 50 years] to |
|---|
| 24 | 24 | | provide for the development, improvement, acquisition, or |
|---|
| 25 | 25 | | management of developed or undeveloped real property [and |
|---|
| 26 | 26 | | construction of facilities] designed to generate revenue for the |
|---|
| 27 | 27 | | financial benefit of the district. The board, directly or through a |
|---|
| 28 | 28 | | nonprofit corporation, may contract or enter into a joint venture |
|---|
| 29 | 29 | | with a public or private entity as necessary to enter into an |
|---|
| 30 | 30 | | agreement [a lease] under this subsection. |

| 31 | 31 | | SECTION 2. Section 281.0511, Health and Safety Code, is |
|---|
| 32 | 32 | | amended by adding Subsection (d) to read as follows: |
|---|
| 33 | 33 | | (d) Notwithstanding any other law, the board may, with the |
|---|
| 34 | 34 | | approval of the commissioners court at a meeting subject to Chapter |
|---|
| 35 | 35 | | 551, Government Code, lease undeveloped or vacant real property for |
|---|
| 36 | 36 | | not more than 99 years to provide for the development and |
|---|
| 37 | 37 | | construction of facilities designed to generate revenue for the |
|---|
| 38 | 38 | | financial benefit of the district. The board, directly or through a |
|---|
| 39 | 39 | | nonprofit corporation, may contract or enter into a joint venture |
|---|
| 40 | 40 | | with a public or private entity as necessary to enter into a lease |
|---|
| 41 | 41 | | under this subsection. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2015. |
