9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 617, Government Code, is amended by |
---|
11 | 11 | | adding Section 617.0021 to read as follows: |

12 | 12 | | Sec. 617.0021. EXCLUSIVE CONSULTATION PROHIBITED. (a) An |
---|
13 | 13 | | official of this state or of a political subdivision of this state |
---|
14 | 14 | | may not enter into a consultation agreement in which one or more |
---|
15 | 15 | | groups are designated as an agent for the purposes of consulting |
---|
16 | 16 | | with or representing public employees on employment issues, |
---|
17 | 17 | | including wages, benefits, and other conditions of employment. |
---|
18 | 18 | | (b) This state or a political subdivision of this state may |
---|
19 | 19 | | not prohibit an employee or a group of employees from seeking |
---|
20 | 20 | | advice, counsel, or the exchange of information on employment |
---|
21 | 21 | | matters, including wages, benefits, employment policies, and other |
---|
22 | 22 | | conditions of employment. |
---|
23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
---|
24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
---|
25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
---|
27 | 27 | | Act takes effect September 1, 2015. |
