77 relating to consultation with public employees concerning
88 employment matters.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 617, Government Code, is amended by
1111 adding Section 617.0021 to read as follows:
1212 Sec. 617.0021. EXCLUSIVE CONSULTATION PROHIBITED. (a) An
1313 official of this state or of a political subdivision of this state
1414 may not enter into a consultation agreement in which one or more
1515 groups are designated as an agent for the purposes of consulting
1616 with or representing public employees on employment issues,
1717 including wages, benefits, and other conditions of employment.
1818 (b) This state or a political subdivision of this state may
1919 not prohibit an employee or a group of employees from seeking
2020 advice, counsel, or the exchange of information on employment
2121 matters, including wages, benefits, employment policies, and other
2222 conditions of employment.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2015.
