77 relating to judicial review of certain workers' compensation
88 disputes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 410.252(a) and (d), Labor Code, are
1111 amended to read as follows:
1212 (a) A party may seek judicial review by filing suit not
1313 later than the 50th [45th] day after the date on which [the division
1414 mailed the party] the decision of the appeals panel [. For purposes
1515 of this section, the mailing date is considered to be the fifth day
1616 after the date the decision of the appeals panel] was filed with the
1717 division.
1818 (d) If a suit is initially filed within the 50-day [45-day]
1919 period in Subsection (a), and is transferred under Subsection (c),
2020 the suit is considered to be timely filed in the court to which it is
2121 transferred.
2222 SECTION 2. The change in law made by this Act applies only
2323 to a suit for judicial review filed on or after the effective date
2424 of this Act. A suit for judicial review filed before the effective
2525 date of this Act is covered by the law as it existed on the date the
2626 suit was filed, and the former law is continued in effect for that
2727 purpose.
2828 SECTION 3. This Act takes effect September 1, 2015.
