| 7 | 7 | | relating to authorizing the Texas Parks and Wildlife Department to |

| 8 | 8 | | enter into certain contracts with private vendors. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter I, Chapter 11, Parks and Wildlife |
|---|
| 11 | 11 | | Code, is amended by adding Section 11.157 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.157. CONTRACTS WITH PRIVATE VENDORS. (a) The |
|---|
| 13 | 13 | | department may contract with private vendors for the construction, |
|---|
| 14 | 14 | | maintenance, or operation of facilities such as lodges or |
|---|
| 15 | 15 | | recreation centers. |
|---|
| 16 | 16 | | (b) A contract entered into by the department with a private |
|---|
| 17 | 17 | | vendor under this section: |
|---|
| 18 | 18 | | (1) must comply with any law generally applicable to a |
|---|
| 19 | 19 | | contract for services entered into by the department; and |
|---|
| 20 | 20 | | (2) must require the private vendor to render at least |
|---|
| 21 | 21 | | quarterly to the department periodic accounts that accurately |
|---|
| 22 | 22 | | detail all material transactions, including information reasonably |
|---|
| 23 | 23 | | required by the department to support fees that are collected by the |
|---|
| 24 | 24 | | vendor, and to regularly remit all money payable to the department |
|---|
| 25 | 25 | | under the contract. |
|---|
| 26 | 26 | | (c) A contract entered into with a private vendor under this |
|---|
| 27 | 27 | | section may provide for the private vendor to recover all costs |
|---|
| 28 | 28 | | incurred by the vendor under the contract. After the vendor has |
|---|
| 29 | 29 | | recovered all of its costs incurred under the contract, the vendor |
|---|
| 30 | 30 | | and the department shall share in the revenue produced by the |
|---|
| 31 | 31 | | contract in proportions to be prescribed by the contract. |
|---|
| 32 | 32 | | (d) An indebtedness, liability, or obligation of a private |
|---|
| 33 | 33 | | vendor incurred in the execution of a contract under this section |
|---|
| 34 | 34 | | does not create a debt or other liability of the department. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2015. |
