55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing the Texas Parks and Wildlife Department to
88 enter into certain contracts with private vendors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter I, Chapter 11, Parks and Wildlife
1111 Code, is amended by adding Section 11.157 to read as follows:
1212 Sec. 11.157. CONTRACTS WITH PRIVATE VENDORS. (a) The
1313 department may contract with private vendors for the construction,
1414 maintenance, or operation of facilities such as lodges or
1515 recreation centers.
1616 (b) A contract entered into by the department with a private
1717 vendor under this section:
1818 (1) must comply with any law generally applicable to a
1919 contract for services entered into by the department; and
2020 (2) must require the private vendor to render at least
2121 quarterly to the department periodic accounts that accurately
2222 detail all material transactions, including information reasonably
2323 required by the department to support fees that are collected by the
2424 vendor, and to regularly remit all money payable to the department
2525 under the contract.
2626 (c) A contract entered into with a private vendor under this
2727 section may provide for the private vendor to recover all costs
2828 incurred by the vendor under the contract. After the vendor has
2929 recovered all of its costs incurred under the contract, the vendor
3030 and the department shall share in the revenue produced by the
3131 contract in proportions to be prescribed by the contract.
3232 (d) An indebtedness, liability, or obligation of a private
3333 vendor incurred in the execution of a contract under this section
3434 does not create a debt or other liability of the department.
3535 SECTION 2. This Act takes effect September 1, 2015.
