1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to a biennial study regarding occupational licensing
1414 requirements.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter A, Chapter 302, Labor Code, is
1717 amended by adding Section 302.0191 to read as follows:
1818 Sec. 302.0191. REPORT REGARDING OCCUPATIONAL LICENSING.
1919 (a) In this section:
2020 (1) "License" includes a certificate, registration,
2121 permit, or other authorization that is issued by a licensing
2222 authority.
2323 (2) "Licensing authority" means a department,
2424 commission, board, office, or other agency of the state that issues
2525 a license.
2626 (b) Subject to the availability of appropriated money, the
2727 commission shall biennially study and report on the extent to which
2828 a requirement that a person must obtain a license to engage in a
2929 particular business, occupation, or profession serves as a barrier
3030 to entry into the workforce. The report must discuss whether and to
3131 what extent license requirements affect unemployment in this state.
3232 (c) In preparing the report required by Subsection (b), the
3333 commission shall:
3434 (1) solicit input from interested parties, including
3535 license holders and licensing authorities, and parties who favor
3636 decreasing or repealing occupational licensing requirements; and
3737 (2) for each license required by a licensing
3838 authority:
3939 (A) evaluate the costs associated with the
4040 license requirement, with a focus on:
4141 (i) unemployment;
4242 (ii) competition within the occupation; and
4343 (iii) associated increases in prices to
4444 consumers of goods or services;
4545 (B) conduct a risk analysis of the harm to
4646 consumers in purchasing goods or services from practitioners in the
4747 licensed occupation;
4848 (C) consider the extent to which consumers are
4949 adequately informed when making decisions related to the licensed
5050 occupation;
5151 (D) consider whether the occupation is capable of
5252 regulating itself without governmental intervention;
5353 (E) consider the availability and adequacy of
5454 alternatives to licensing by the state, including nonexclusive
5555 certifications or registrations provided by nongovernmental
5656 entities;
5757 (F) consider whether the license requirement
5858 serves to protect existing practitioners;
5959 (G) conduct a cost-benefit analysis to determine
6060 if the social costs of the license requirement are justified by any
6161 benefits to the public health, safety, or welfare; and
6262 (H) consider the anticipated effect of repealing
6363 the license requirement on:
6464 (i) overall unemployment, including the
6565 rate at which people seeking to enter the occupation or profession
6666 are able to do so; and
6767 (ii) workforce training costs incurred by
6868 the state, community colleges, or career schools or colleges.
6969 (d) The commission by rule shall establish a schedule for
7070 the review of licenses under this section. The rules must require
7171 that:
7272 (1) the commission review each license required by a
7373 licensing authority not more than once in a 10-year period; and
7474 (2) the commission review approximately 10 percent of
7575 the licenses during each biennium.
7676 (e) On request of the commission, a licensing authority
7777 shall provide information to the commission or otherwise assist the
7878 commission in preparing the report. On request of the commission, a
7979 licensing authority and the Sunset Advisory Commission shall
8080 provide staff support to the commission for purposes of conducting
8181 the study and preparing the report required by this section.
8282 (f) Not later than November 15 of each even-numbered year,
8383 the commission shall:
8484 (1) provide a copy of the report to:
8585 (A) the governor;
8686 (B) the lieutenant governor;
8787 (C) the speaker of the house of representatives;
8888 and
8989 (D) each standing committee of the senate and
9090 house of representatives having primary jurisdiction over matters
9191 relating to occupational licensing; and
9292 (2) make the report available to the public on the
9393 commission's Internet website.
9494 (g) The commission may solicit, accept, and administer
9595 gifts, grants, and donations of any kind from any public or private
9696 source for the purposes of conducting the study and preparing the
9797 report required by this section.
9898 SECTION 2. This Act takes effect September 1, 2015.
