77 relating to consideration of a bidder's principal place of business
88 by public junior college districts in awarding certain contracts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 130.010, Education Code, is amended to
1111 read as follows:
1212 Sec. 130.010. PURCHASING CONTRACTS. (a) Except as
1313 provided by Subsection (c), the [The] provisions of Subchapter B,
1414 Chapter 44, relating to the purchase of goods and services under
1515 contract by a school district apply to the purchase of goods and
1616 services under contract by a junior college district.
1717 (b) To the extent of any conflict, the provisions of this
1818 section and Subchapter B, Chapter 44, prevail over any other law
1919 relating to the purchase of goods and services by a junior college
2020 district.
2121 (c) A junior college district, in awarding a contract by
2222 competitive sealed bid, may consider the location of a bidder's
2323 principal place of business in the manner provided by Sections
2424 271.905 and 271.9051, Local Government Code.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
