99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to fees charged by the Coastal Plains Groundwater
1212 Conservation District.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 8831.151, Special District Local Laws
1515 Code, is amended to read as follows:
1616 Sec. 8831.151. DISTRICT REVENUE AND FEES. To accomplish
1717 the regulatory goals of the district, to pay the district's
1818 maintenance and operating costs, and to pay any bonds issued by the
1919 district, the district may:
2020 (1) impose an ad valorem tax at a rate not to exceed
2121 2.5 cents for each $100 of taxable value of property in the
2222 district, subject to voter approval;
2323 (2) assess production fees as authorized by Section
2424 36.205, Water Code [for services or for water withdrawn from
2525 wells]; [or]
2626 (3) solicit and accept grants from any public or
2727 private source; and
2828 (4) assess:
2929 (A) an export fee on groundwater exported from
3030 the district in an amount not to exceed 150 percent of the maximum
3131 wholesale water rate charged by the City of Houston; and
3232 (B) other fees authorized by Chapter 36, Water
3333 Code.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2015.
