55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the privacy of certain personal information held by
88 health and human services agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 531, Government Code, is amended by
1111 adding Subchapter V-1 to read as follows:
1212 SUBCHAPTER V-1. PRIVACY OF PERSONAL INFORMATION
1313 Sec. 531.931. DEFINITION. In this subchapter, "personal
1414 information" includes:
1515 (1) information that alone or in conjunction with
1616 other information identifies an individual, including an
1717 individual's:
1818 (A) name, social security number, date of birth,
1919 or government-issued identification number;
2020 (B) mother's maiden name;
2121 (C) unique biometric data, including the
2222 individual's fingerprint, voice print, and retina or iris image;
2323 (D) unique electronic identification number,
2424 address, or routing code;
2525 (E) telecommunication access device as defined
2626 by Section 32.51, Penal Code; and
2727 (F) financial institution account number or
2828 credit or debit card number; and
2929 (2) information that relates to:
3030 (A) the physical or mental health or condition of
3131 an individual;
3232 (B) the provision of health care to an
3333 individual; or
3434 (C) payment for the provision of health care to
3535 an individual.
3636 Sec. 531.932. SALE OF PERSONAL INFORMATION. (a) A health
3737 and human services agency may not sell personal information to any
3838 person unless the agency obtains the consent of the individual who
3939 is the subject of the information.
4040 (b) An agency may not require an individual to consent to
4141 the sale of personal information as a condition of receiving
4242 services from the agency.
4343 Sec. 531.933. PURCHASE OF PERSONAL INFORMATION; PUBLIC
4444 INFORMATION. The name of a person that purchases personal
4545 information from a health and human services agency is public
4646 information subject to disclosure under Chapter 552.
4747 Sec. 531.934. RESALE PROHIBITED. (a) A person who
4848 purchases personal information from a health and human services
4949 agency may not resell the information.
5050 (b) A person who the executive commissioner finds has
5151 violated this section is prohibited from purchasing personal
5252 information from any health and human services agency until on or
5353 after the second anniversary of the violation.
5454 SECTION 2. This Act takes effect September 1, 2015.
