77 relating to a combined online application for persons applying for
88 certain state and local economic development incentives.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 481, Government Code, is
1111 amended by adding Section 481.0785 to read as follows:
1212 Sec. 481.0785. COMBINED ONLINE APPLICATION FOR CERTAIN
1313 STATE AND LOCAL ECONOMIC DEVELOPMENT INCENTIVES. (a) The office,
1414 in coordination with the Texas Workforce Commission and the
1515 comptroller, shall establish a single online application that
1616 persons, including employers and public community and technical
1717 colleges, may use to apply for monetary incentives from the Texas
1818 Enterprise Fund under this subchapter and the skills development
1919 fund under Chapter 303, Labor Code, and tax incentives under
2020 Chapter 313, Tax Code.
2121 (b) The single application shall be made available on the
2222 office of the governor's Internet website, and the Texas Workforce
2323 Commission's and the comptroller's Internet websites shall provide
2424 a link to the application. If a school district maintains a
2525 generally accessible Internet website, the district shall provide
2626 on its website a link to the application.
2727 SECTION 2. Section 303.005(a), Labor Code, is amended to
2828 read as follows:
2929 (a) An employer may not apply both to a public community or
3030 technical college for customized training and assessment from the
3131 college through a grant issued to the college under the skills
3232 development fund program established under this chapter and for a
3333 grant under the Texas Enterprise Fund program established under
3434 Subchapter E, Chapter 481, Government Code, unless the employer and
3535 the college file an application for concurrent participation in
3636 both programs using a single application under Section 481.0785,
3737 Government Code [that complies with any rules adopted by the Texas
3838 Workforce Commission on concurrent participation].
3939 SECTION 3. Section 313.031, Tax Code, is amended by adding
4040 Subsection (b-1) to read as follows:
4141 (b-1) For purposes of this chapter, including Section
4242 313.025(a), an application made using a single application under
4343 Section 481.0785, Government Code, is considered to be an
4444 application on a form prescribed by the comptroller.
4545 SECTION 4. This Act takes effect September 1, 2015.
