75 relating to defining the duties and to the penalties concerning
86 pain management clinics.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 168.001, Occupations Code, is amended to
119 read as follows:
1210 Sec. 168.001. DEFINITIONS [DEFINITION]. In this chapter:
1311 (1) [In this chapter,] "Pain [pain] management clinic"
1412 means a publicly or privately owned facility for which a majority of
1513 patients are issued on a monthly basis a prescription for opioids,
1614 benzodiazepines, barbiturates, or carisoprodol, but not including
1715 suboxone.
1816 (2) "Operator" means an owner, medical director, or
1917 physician affiliated or associated with the pain management clinic
2018 in any capacity. Each of these individuals is considered to be
2119 operating at the pain management clinic.
2220 SECTION 2. Section 168.201(d), Occupations Code, is amended
2321 to read as follows:
2422 (d) A person who owns or operates a pain management clinic
2523 is engaged in the practice of medicine. This shall include, but is
2624 not limited to, all supervision and delegation activities related
2725 to the pain management clinic.
2826 SECTION 3. Section 168.202(c), Occupations Code, is amended
2927 by adding Subsection (c) to read as follows:
3028 (c) A violation of this chapter is subject to criminal
3129 prosecution under Section 165.152.
3230 SECTION 4. This Act takes effect September 1, 2015.
