| 7 | 7 | | relating to transparency in economic development negotiations |

| 8 | 8 | | involving a governmental body and a business prospect. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 552.305(d), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (d) If release of a person's proprietary information may be |
|---|
| 13 | 13 | | subject to exception under Section 552.101, 552.110, or 552.113, |
|---|
| 14 | 14 | | [or 552.131,] the governmental body that requests an attorney |
|---|
| 15 | 15 | | general decision under Section 552.301 shall make a good faith |
|---|
| 16 | 16 | | attempt to notify that person of the request for the attorney |
|---|
| 17 | 17 | | general decision. Notice under this subsection must: |
|---|
| 18 | 18 | | (1) be in writing and sent within a reasonable time not |
|---|
| 19 | 19 | | later than the 10th business day after the date the governmental |
|---|
| 20 | 20 | | body receives the request for the information; and |
|---|
| 21 | 21 | | (2) include: |
|---|
| 22 | 22 | | (A) a copy of the written request for the |
|---|
| 23 | 23 | | information, if any, received by the governmental body; and |
|---|
| 24 | 24 | | (B) a statement, in the form prescribed by the |
|---|
| 25 | 25 | | attorney general, that the person is entitled to submit in writing |
|---|
| 26 | 26 | | to the attorney general within a reasonable time not later than the |
|---|
| 27 | 27 | | 10th business day after the date the person receives the notice: |
|---|
| 28 | 28 | | (i) each reason the person has as to why the |
|---|
| 29 | 29 | | information should be withheld; and |
|---|
| 30 | 30 | | (ii) a letter, memorandum, or brief in |
|---|
| 31 | 31 | | support of that reason. |
|---|
| 32 | 32 | | SECTION 2. Sections 551.087 and 552.131, Government Code, |
|---|
| 33 | 33 | | are repealed. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2015. |
