66 AN ACT
77 relating to transparency in economic development negotiations
88 involving a governmental body and a business prospect.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 552.305(d), Government Code, is amended
1111 to read as follows:
1212 (d) If release of a person's proprietary information may be
1313 subject to exception under Section 552.101, 552.110, or 552.113,
1414 [or 552.131,] the governmental body that requests an attorney
1515 general decision under Section 552.301 shall make a good faith
1616 attempt to notify that person of the request for the attorney
1717 general decision. Notice under this subsection must:
1818 (1) be in writing and sent within a reasonable time not
1919 later than the 10th business day after the date the governmental
2020 body receives the request for the information; and
2121 (2) include:
2222 (A) a copy of the written request for the
2323 information, if any, received by the governmental body; and
2424 (B) a statement, in the form prescribed by the
2525 attorney general, that the person is entitled to submit in writing
2626 to the attorney general within a reasonable time not later than the
2727 10th business day after the date the person receives the notice:
2828 (i) each reason the person has as to why the
2929 information should be withheld; and
3030 (ii) a letter, memorandum, or brief in
3131 support of that reason.
3232 SECTION 2. Sections 551.087 and 552.131, Government Code,
3333 are repealed.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2015.
