| 7 | 7 | | relating to the selection of certain providers under the Medicaid |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 32.027(l), Human Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (l) Subject to appropriations, the department shall assure |
|---|
| 13 | 13 | | that a recipient of medical assistance under this chapter may |
|---|
| 14 | 14 | | select a licensed psychologist, a licensed marriage and family |
|---|
| 15 | 15 | | therapist, as defined by Section 502.002, Occupations Code, a |
|---|
| 16 | 16 | | licensed professional counselor, as defined by Section 503.002, |
|---|
| 17 | 17 | | Occupations Code, or practicing in accordance with Section 503.308, |
|---|
| 18 | 18 | | Occupations Code, or a licensed master social worker, as defined by |
|---|
| 19 | 19 | | Section 505.002, Occupations Code, to perform any health care |
|---|
| 20 | 20 | | service or procedure covered under the medical assistance program |
|---|
| 21 | 21 | | if the selected person is authorized by law to perform the service |
|---|
| 22 | 22 | | or procedure. This subsection shall be liberally construed. |
|---|
| 23 | 23 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 24 | 24 | | a state agency determines that a waiver or authorization from a |
|---|
| 25 | 25 | | federal agency is necessary for implementation of that provision, |
|---|
| 26 | 26 | | the agency affected by the provision shall request the waiver or |
|---|
| 27 | 27 | | authorization and may delay implementing that provision until the |
|---|
| 28 | 28 | | waiver or authorization is granted. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2015. |
