66 AN ACT
77 relating to the selection of certain providers under the Medicaid
88 program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.027(l), Human Resources Code, is
1111 amended to read as follows:
1212 (l) Subject to appropriations, the department shall assure
1313 that a recipient of medical assistance under this chapter may
1414 select a licensed psychologist, a licensed marriage and family
1515 therapist, as defined by Section 502.002, Occupations Code, a
1616 licensed professional counselor, as defined by Section 503.002,
1717 Occupations Code, or practicing in accordance with Section 503.308,
1818 Occupations Code, or a licensed master social worker, as defined by
1919 Section 505.002, Occupations Code, to perform any health care
2020 service or procedure covered under the medical assistance program
2121 if the selected person is authorized by law to perform the service
2222 or procedure. This subsection shall be liberally construed.
2323 SECTION 2. If before implementing any provision of this Act
2424 a state agency determines that a waiver or authorization from a
2525 federal agency is necessary for implementation of that provision,
2626 the agency affected by the provision shall request the waiver or
2727 authorization and may delay implementing that provision until the
2828 waiver or authorization is granted.
2929 SECTION 3. This Act takes effect September 1, 2015.
