44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the compensation of associate judges appointed to
77 hear Title IV-D cases and child protection cases.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 201.105, Family Code, is amended to read
1010 as follows:
1111 Sec. 201.105. COMPENSATION OF ASSOCIATE JUDGE. (a) An
1212 associate judge appointed under this subchapter is entitled to
1313 receive from the state a salary in an amount equal to [be determined
1414 by a majority vote of the presiding judges of the administrative
1515 judicial regions. The salary may not exceed] 90 percent of the
1616 salary paid to a district judge as set by the General Appropriations
1717 Act.
1818 (b) Notwithstanding any other law, longevity pay paid to an
1919 associate judge under Section 659.044, Government Code, is not
2020 included as part of the [The] associate judge's salary amount
2121 provided by subsection (a) [shall be paid from county funds
2222 available for payment of officers' salaries or from funds available
2323 from the state and federal government as provided by this
2424 subchapter].
2525 (c) The office of court administration in accordance with
2626 this subchapter may use federal funds obtained from the Title IV-D
2727 agency to cover the costs of an associate judge's salary.
2828 Section 2. Section 201.205, Family Code, is amended to read
2929 as follows:
3030 Sec. 201.205. COMPENSATION OF ASSOCIATE JUDGE. (a) An
3131 associate judge appointed under this subchapter is entitled to
3232 receive from the state a salary in an amount equal to [as determined
3333 by a majority vote of the presiding judges of the administrative
3434 judicial regions. The salary may not exceed] 90 percent of the
3535 salary paid to a district judge as set by the state General
3636 Appropriations Act.
3737 (b) Notwithstanding any other law, longevity pay that is
3838 paid to an associate judge under Section 659.044, Government Code,
3939 is not included as part of the associate judge's salary amount
4040 provided by subsection (a).
4141 (c) [(b)] The associate judge's salary shall be paid from
4242 county funds available for payment of officers' salaries subject to
4343 the approval of the commissioners court or from funds available
4444 from the state and federal governments as provided by this
4545 subchapter.
4646 SECTION 3. This Act takes effect September 1, 2015.
