66 AN ACT
77 relating to requirements regarding certain purchasing and
88 contracting guidelines for open-enrollment charter schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 12, Education Code, is
1111 amended by adding Section 12.10531 to read as follows:
1212 Sec. 12.10531. REQUIREMENTS REGARDING CERTAIN PURCHASING
1313 AND CONTRACTING GUIDELINES. (a) In this section:
1414 (1) "Historically underutilized business" has the
1515 meaning assigned by Section 2161.001, Government Code.
1616 (2) "Minority business" and "women-owned business"
1717 have the meanings assigned by Section 381.004, Local Government
1818 Code.
1919 (b) An open-enrollment charter school shall follow the
2020 purchasing and contracting guidelines adopted by the school
2121 district in which the charter school is located regarding the
2222 acquisition of goods and services through historically
2323 underutilized businesses, minority businesses, and women-owned
2424 businesses.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
