| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 12, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 12.10531 to read as follows: |
|---|
| 12 | 12 | | Sec. 12.10531. REQUIREMENTS REGARDING CERTAIN PURCHASING |
|---|
| 13 | 13 | | AND CONTRACTING GUIDELINES. (a) In this section: |
|---|
| 14 | 14 | | (1) "Historically underutilized business" has the |
|---|
| 15 | 15 | | meaning assigned by Section 2161.001, Government Code. |
|---|
| 16 | 16 | | (2) "Minority business" and "women-owned business" |
|---|
| 17 | 17 | | have the meanings assigned by Section 381.004, Local Government |
|---|
| 18 | 18 | | Code. |
|---|
| 19 | 19 | | (b) An open-enrollment charter school shall follow the |
|---|
| 20 | 20 | | purchasing and contracting guidelines adopted by the school |
|---|
| 21 | 21 | | district in which the charter school is located regarding the |
|---|
| 22 | 22 | | acquisition of goods and services through historically |
|---|
| 23 | 23 | | underutilized businesses, minority businesses, and women-owned |
|---|
| 24 | 24 | | businesses. |

| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2015. |
