5- A BILL TO BE ENTITLED
64 AN ACT
75 relating to designated emergency infant care providers for certain
86 abandoned children.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 262.301(1), Family Code, as amended by
119 S.B. No. 219, Acts of the 84th Legislature, Regular Session, 2015,
1210 is amended to read as follows:
1311 (1) "Designated emergency infant care provider"
1412 means:
1513 (A) an emergency medical services provider;
1614 (B) a hospital; [or]
1715 (C) a freestanding emergency medical care
1816 facility licensed under Chapter 254, Health and Safety Code; or
1917 (D) a child-placing agency licensed by the
2018 Department of Family and Protective Services under Chapter 42,
2119 Human Resources Code, that:
2220 (i) agrees to act as a designated emergency
2321 infant care provider under this subchapter; and
2422 (ii) has on staff a person who is licensed
2523 as a registered nurse under Chapter 301, Occupations Code, or who
2624 provides emergency medical services under Chapter 773, Health and
2725 Safety Code, and who will examine and provide emergency medical
2826 services to a child taken into possession by the agency under this
2927 subchapter.
3028 SECTION 2. The change in law made by this Act applies to an
3129 exception asserted to an offense under Section 22.041, Penal Code,
3230 regardless of when the offense was committed, but only if the trial
3331 for the offense commences on or after the effective date of this
3432 Act.
3533 SECTION 3. This Act takes effect September 1, 2015.
