| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Section 262.301(1), Family Code, as amended by |
|---|
| 11 | 9 | | S.B. No. 219, Acts of the 84th Legislature, Regular Session, 2015, |
|---|
| 12 | 10 | | is amended to read as follows: |
|---|
| 13 | 11 | | (1) "Designated emergency infant care provider" |
|---|
| 14 | 12 | | means: |
|---|
| 15 | 13 | | (A) an emergency medical services provider; |
|---|
| 16 | 14 | | (B) a hospital; [or] |
|---|
| 17 | 15 | | (C) a freestanding emergency medical care |
|---|
| 18 | 16 | | facility licensed under Chapter 254, Health and Safety Code; or |
|---|
| 19 | 17 | | (D) a child-placing agency licensed by the |
|---|
| 20 | 18 | | Department of Family and Protective Services under Chapter 42, |
|---|
| 21 | 19 | | Human Resources Code, that: |
|---|
| 22 | 20 | | (i) agrees to act as a designated emergency |
|---|
| 23 | 21 | | infant care provider under this subchapter; and |
|---|
| 24 | 22 | | (ii) has on staff a person who is licensed |
|---|
| 25 | 23 | | as a registered nurse under Chapter 301, Occupations Code, or who |
|---|
| 26 | 24 | | provides emergency medical services under Chapter 773, Health and |
|---|
| 27 | 25 | | Safety Code, and who will examine and provide emergency medical |
|---|
| 28 | 26 | | services to a child taken into possession by the agency under this |
|---|
| 29 | 27 | | subchapter. |
|---|
| 30 | 28 | | SECTION 2. The change in law made by this Act applies to an |
|---|
| 31 | 29 | | exception asserted to an offense under Section 22.041, Penal Code, |
|---|
| 32 | 30 | | regardless of when the offense was committed, but only if the trial |
|---|
| 33 | 31 | | for the offense commences on or after the effective date of this |
|---|
| 34 | 32 | | Act. |
|---|
| 35 | 33 | | SECTION 3. This Act takes effect September 1, 2015. |
