9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 411, Government Code, is | |
11 | 11 | amended by adding Section 411.0094 to read as follows: | |
12 | 12 | Sec. 411.0094. AUTOMATIC LICENSE PLATE READER. (a) In this | |
13 | 13 | section, "automatic license plate reader" means a system that reads | |
14 | 14 | and records license plate numbers taken from digital photographs. | |
15 | 15 | (b) A law enforcement agency may use an automatic license | |
16 | 16 | plate reader. | |
17 | 17 | (c) Images and any related data produced from an automatic | |
18 | 18 | license plate reader under Subsection (b) may be used only for the | |
19 | 19 | following law enforcement purposes: | |
20 | 20 | (1) investigating a criminal offense; or | |
21 | 21 | (2) investigating a report of a missing person. | |
22 | 22 | (d) All images and data produced from an automatic license | |
23 | 23 | plate reader under this section shall be destroyed not later than | |
24 | 24 | the seventh day after the date of collection unless the image or | |
25 | 25 | data is evidence in a criminal investigation or prosecution. | |
26 | 26 | (e) The department shall adopt rules as necessary to | |
27 | 27 | implement this section. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2015. |
