| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 361.096, Health and Safety Code, is | |
| 12 | 12 | amended by amending Subsection (a) and adding Subsection (c) to | |
| 13 | 13 | read as follows: | |
| 14 | 14 | (a) Except as provided by Subsection (c) and as otherwise | |
| 15 | 15 | specifically provided by this chapter, this subchapter does not | |
| 16 | 16 | limit the powers and duties of a local government or other political | |
| 17 | 17 | subdivision of the state as conferred by this or other law. | |
| 18 | 18 | (c) Notwithstanding any other law, a local government or | |
| 19 | 19 | other political subdivision of the state may not adopt a rule or | |
| 20 | 20 | ordinance that conflicts with or is otherwise inconsistent with the | |
| 21 | 21 | requirements for solid waste management facilities as specified by | |
| 22 | 22 | the rules of the commission or by a permit issued by the commission. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2015. |
