| 8 | 8 | | being of unique ecological value. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. DEFINITION. In this Act, "Region L" means |
|---|
| 11 | 11 | | Regional Water Planning Area L designated in accordance with |
|---|
| 12 | 12 | | Section 16.053, Water Code, as the area's boundaries existed on |
|---|
| 13 | 13 | | September 1, 2015. |
|---|
| 14 | 14 | | SECTION 2. DESIGNATION OF RIVER OR STREAM SEGMENTS OF |
|---|
| 15 | 15 | | UNIQUE ECOLOGICAL VALUE. The legislature, as authorized by Section |
|---|
| 16 | 16 | | 16.051(f), Water Code, designates as being of unique ecological |
|---|
| 17 | 17 | | value the following river or stream segments: |
|---|
| 18 | 18 | | (1) the Nueces River from the northern boundary of |
|---|
| 19 | 19 | | Region L to United States Geological Survey gauge number 08190000; |
|---|
| 20 | 20 | | (2) the Frio River from the northern boundary of |
|---|
| 21 | 21 | | Region L to United States Geological Survey gauge number 08195000; |
|---|
| 22 | 22 | | (3) the Sabinal River from the northern boundary of |
|---|
| 23 | 23 | | Region L to its intersection with State Highway 187; |
|---|
| 24 | 24 | | (4) the San Marcos River from a point 0.4 miles |
|---|
| 25 | 25 | | upstream from its intersection with State Highway Loop 82 to its |
|---|
| 26 | 26 | | intersection with Interstate Highway 35; and |
|---|
| 27 | 27 | | (5) the Comal River from its intersection with East |
|---|
| 28 | 28 | | Klingemann Street in New Braunfels to its confluence with the |
|---|
| 29 | 29 | | Guadalupe River. |
|---|
| 30 | 30 | | SECTION 3. EFFECT OF DESIGNATION. The designation of a |
|---|
| 31 | 31 | | river or stream segment as being of unique ecological value under |
|---|
| 32 | 32 | | Section 2 of this Act: |
|---|
| 33 | 33 | | (1) means only that a state agency or political |
|---|
| 34 | 34 | | subdivision of the state may not finance the actual construction of |
|---|
| 35 | 35 | | a reservoir in the designated segment; |
|---|
| 36 | 36 | | (2) does not affect the ability of a state agency or |
|---|
| 37 | 37 | | political subdivision of the state to construct, operate, maintain, |
|---|
| 38 | 38 | | or replace a weir, a water diversion, flood control, drainage, or |
|---|
| 39 | 39 | | water supply system, a low water crossing, or a recreational |
|---|
| 40 | 40 | | facility in the designated segment; |
|---|
| 41 | 41 | | (3) does not prohibit the permitting, financing, |
|---|
| 42 | 42 | | construction, operation, maintenance, or replacement of any water |
|---|
| 43 | 43 | | management strategy to meet projected water supply needs |
|---|
| 44 | 44 | | recommended in, or designated as an alternative in, the 2011 or 2016 |
|---|
| 45 | 45 | | Regional Water Plan for Region L; and |
|---|
| 46 | 46 | | (4) does not alter any existing property right of an |
|---|
| 47 | 47 | | affected landowner. |
|---|
| 48 | 48 | | SECTION 4. EFFECTIVE DATE. This Act takes effect September |
|---|
| 49 | 49 | | 1, 2015. |
