9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 571.131, Government Code, is amended by | |
11 | 11 | adding Subsection (d) to read as follows: | |
12 | 12 | (d) Chapter 27, Civil Practice and Remedies Code, applies to | |
13 | 13 | a formal hearing conducted under this chapter. For purposes of this | |
14 | 14 | subsection: | |
15 | 15 | (1) the authority holding the hearing has the duties | |
16 | 16 | and authority of the court under Chapter 27, Civil Practice and | |
17 | 17 | Remedies Code; and | |
18 | 18 | (2) a formal hearing is considered to be a legal | |
19 | 19 | action. | |
20 | 20 | SECTION 2. Section 571.131, Government Code, as amended by | |
21 | 21 | this Act, applies only to a formal hearing conducted by the Texas | |
22 | 22 | Ethics Commission on or after the effective date of this Act. A | |
23 | 23 | formal hearing conducted by the Texas Ethics Commission before the | |
24 | 24 | effective date of this Act is governed by the law in effect at the | |
25 | 25 | time the hearing is conducted, and the former law is continued in | |
26 | 26 | effect for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2015. |
