| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subtitle B, Title 13, Occupations Code, is |
|---|
| 10 | 10 | | amended by adding Chapter 2053 to read as follows: |
|---|
| 11 | 11 | | CHAPTER 2053. REQUIREMENTS FOR COACHES OF YOUTH SPORTS PROGRAM |
|---|
| 12 | 12 | | Sec. 2053.001. DEFINITIONS. In this chapter: |
|---|
| 13 | 13 | | (1) "Coach" means a person who provides training, |
|---|
| 14 | 14 | | teaching, or similar services to participants in a youth sports |
|---|
| 15 | 15 | | program. |
|---|
| 16 | 16 | | (2) "Youth sports program" means an entity that |
|---|
| 17 | 17 | | provides an organized athletic program that is not associated with |
|---|
| 18 | 18 | | a school and is for children who are enrolled in kindergarten |
|---|
| 19 | 19 | | through sixth grade in a public, private, or charter school or |
|---|
| 20 | 20 | | children of similar age who are provided an education in a home |
|---|
| 21 | 21 | | setting. |
|---|
| 22 | 22 | | Sec. 2053.002. TRAINING AND CRIMINAL HISTORY RECORD CHECK |
|---|
| 23 | 23 | | REQUIRED. (a) A person may not act as a coach for a youth sports |
|---|
| 24 | 24 | | program unless the person has successfully completed a youth sports |
|---|
| 25 | 25 | | training course that meets the requirements of this chapter and |
|---|
| 26 | 26 | | rules adopted under this chapter and includes a criminal history |
|---|
| 27 | 27 | | record check ascertaining whether the person is registered as a sex |
|---|
| 28 | 28 | | offender under Chapter 62, Code of Criminal Procedure. |
|---|
| 29 | 29 | | (b) A youth sports training course required by this section |
|---|
| 30 | 30 | | may be offered or facilitated only by a sports foundation, a |
|---|
| 31 | 31 | | nonprofit national youth sports organization that requires and |
|---|
| 32 | 32 | | administers a participant certification program, a coaches |
|---|
| 33 | 33 | | association, a national governing body as that term is defined by |
|---|
| 34 | 34 | | the Ted Stevens Olympic and Amateur Sports Act (36 U.S.C. Section |
|---|
| 35 | 35 | | 220501), or a public or private high school or middle school |
|---|
| 36 | 36 | | athletic department. |
|---|
| 37 | 37 | | (c) A youth sports training course must include: |
|---|
| 38 | 38 | | (1) at least two hours of in-person or online specific |
|---|
| 39 | 39 | | sport skills-based coaching instruction; and |
|---|
| 40 | 40 | | (2) at least two hours of in-person non-skills-based |
|---|
| 41 | 41 | | coaching instruction that, at a minimum, addresses: |
|---|
| 42 | 42 | | (A) the role of a youth sports coach; |
|---|
| 43 | 43 | | (B) communication and accountability by and |
|---|
| 44 | 44 | | between coaches, participants, and parents; |
|---|
| 45 | 45 | | (C) suggestions for teaching and modeling life |
|---|
| 46 | 46 | | skills; |
|---|
| 47 | 47 | | (D) child developmental stages and corresponding |
|---|
| 48 | 48 | | age-appropriate communication and discipline; and |
|---|
| 49 | 49 | | (E) the health, safety, and legal |
|---|
| 50 | 50 | | responsibilities of coaches. |
|---|
| 51 | 51 | | Sec. 2053.003. LIABILITY INSURANCE INFORMATION. An |
|---|
| 52 | 52 | | organization that provides a youth sports training course may offer |
|---|
| 53 | 53 | | to coaches attending the course information on the availability of |
|---|
| 54 | 54 | | liability insurance for the coaches and their players. |
|---|
| 55 | 55 | | Sec. 2053.004. RULES. The Texas Commission of Licensing |
|---|
| 56 | 56 | | and Regulation may adopt the rules necessary to implement this |
|---|
| 57 | 57 | | chapter. |
|---|
| 58 | 58 | | SECTION 2. (a) Not later than December 1, 2015, the Texas |
|---|
| 59 | 59 | | Commission of Licensing and Regulation shall adopt any rules |
|---|
| 60 | 60 | | necessary to implement Chapter 2053, Occupations Code, as added by |
|---|
| 61 | 61 | | this Act. |
|---|
| 62 | 62 | | (b) The changes in law made by this Act apply only to a coach |
|---|
| 63 | 63 | | who is coaching a youth sports program for a sports season that |
|---|
| 64 | 64 | | begins on or after January 1, 2016. A coach who is coaching a youth |
|---|
| 65 | 65 | | sports program during a sports season that began before that date is |
|---|
| 66 | 66 | | governed by the law in effect immediately before the effective date |
|---|
| 67 | 67 | | of this Act, and that law is continued in effect for that purpose. |
|---|
| 68 | 68 | | SECTION 3. This Act takes effect September 1, 2015. |
