77 relating to requirements for coaches of youth sports programs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle B, Title 13, Occupations Code, is
1010 amended by adding Chapter 2053 to read as follows:
1111 CHAPTER 2053. REQUIREMENTS FOR COACHES OF YOUTH SPORTS PROGRAM
1212 Sec. 2053.001. DEFINITIONS. In this chapter:
1313 (1) "Coach" means a person who provides training,
1414 teaching, or similar services to participants in a youth sports
1515 program.
1616 (2) "Youth sports program" means an entity that
1717 provides an organized athletic program that is not associated with
1818 a school and is for children who are enrolled in kindergarten
1919 through sixth grade in a public, private, or charter school or
2020 children of similar age who are provided an education in a home
2121 setting.
2222 Sec. 2053.002. TRAINING AND CRIMINAL HISTORY RECORD CHECK
2323 REQUIRED. (a) A person may not act as a coach for a youth sports
2424 program unless the person has successfully completed a youth sports
2525 training course that meets the requirements of this chapter and
2626 rules adopted under this chapter and includes a criminal history
2727 record check ascertaining whether the person is registered as a sex
2828 offender under Chapter 62, Code of Criminal Procedure.
2929 (b) A youth sports training course required by this section
3030 may be offered or facilitated only by a sports foundation, a
3131 nonprofit national youth sports organization that requires and
3232 administers a participant certification program, a coaches
3333 association, a national governing body as that term is defined by
3434 the Ted Stevens Olympic and Amateur Sports Act (36 U.S.C. Section
3535 220501), or a public or private high school or middle school
3636 athletic department.
3737 (c) A youth sports training course must include:
3838 (1) at least two hours of in-person or online specific
3939 sport skills-based coaching instruction; and
4040 (2) at least two hours of in-person non-skills-based
4141 coaching instruction that, at a minimum, addresses:
4242 (A) the role of a youth sports coach;
4343 (B) communication and accountability by and
4444 between coaches, participants, and parents;
4545 (C) suggestions for teaching and modeling life
4646 skills;
4747 (D) child developmental stages and corresponding
4848 age-appropriate communication and discipline; and
4949 (E) the health, safety, and legal
5050 responsibilities of coaches.
5151 Sec. 2053.003. LIABILITY INSURANCE INFORMATION. An
5252 organization that provides a youth sports training course may offer
5353 to coaches attending the course information on the availability of
5454 liability insurance for the coaches and their players.
5555 Sec. 2053.004. RULES. The Texas Commission of Licensing
5656 and Regulation may adopt the rules necessary to implement this
5757 chapter.
5858 SECTION 2. (a) Not later than December 1, 2015, the Texas
5959 Commission of Licensing and Regulation shall adopt any rules
6060 necessary to implement Chapter 2053, Occupations Code, as added by
6161 this Act.
6262 (b) The changes in law made by this Act apply only to a coach
6363 who is coaching a youth sports program for a sports season that
6464 begins on or after January 1, 2016. A coach who is coaching a youth
6565 sports program during a sports season that began before that date is
6666 governed by the law in effect immediately before the effective date
6767 of this Act, and that law is continued in effect for that purpose.
6868 SECTION 3. This Act takes effect September 1, 2015.
