| 13 | 13 | | relating to grants to local governmental entities from the Texas |

| 14 | 14 | | Military Preparedness Commission. |

| 15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Section 436.202, Government Code, is amended by |
|---|
| 17 | 17 | | amending Subsections (a), (b), and (c) and adding Subsection (e) to |
|---|
| 18 | 18 | | read as follows: |
|---|
| 19 | 19 | | (a) From money appropriated for this purpose, the |
|---|
| 20 | 20 | | commission may make a grant to an eligible local governmental |
|---|
| 21 | 21 | | entity to: |
|---|
| 22 | 22 | | (1) enable the entity to match money or meet an |
|---|
| 23 | 23 | | investment requirement necessary to receive federal assistance |
|---|
| 24 | 24 | | provided to the local governmental entity for responding to or |
|---|
| 25 | 25 | | recovering from an event described by Section 436.201(b); |
|---|
| 26 | 26 | | (2) match the entity's contribution for a purpose |
|---|
| 27 | 27 | | described by Section 436.203 at a closed or realigned defense |
|---|
| 28 | 28 | | facility; [or] |
|---|
| 29 | 29 | | (3) construct infrastructure and other projects |
|---|
| 30 | 30 | | necessary to accommodate a new or expanded military mission at a |
|---|
| 31 | 31 | | military base or to reduce the impact of an action of the United |
|---|
| 32 | 32 | | States Department of Defense that will negatively impact a defense |
|---|
| 33 | 33 | | facility located in or near the entity; or |
|---|
| 34 | 34 | | (4) construct affordable single family, multifamily, |
|---|
| 35 | 35 | | and veteran's supportive housing financed under the low income |
|---|
| 36 | 36 | | housing tax credit program under Subchapter DD, Chapter 2306. |
|---|
| 37 | 37 | | (b) The commission may not make a grant for an amount less |
|---|
| 38 | 38 | | than $50,000 or an amount more than the lesser of: |
|---|
| 39 | 39 | | (1) 50 percent of the amount of matching money or |
|---|
| 40 | 40 | | investment that the local governmental entity is required to |
|---|
| 41 | 41 | | provide, subject to Subsection (c); |
|---|
| 42 | 42 | | (2) 50 percent of the local governmental entity's |
|---|
| 43 | 43 | | investment for purposes described by Section 436.203 if federal |
|---|
| 44 | 44 | | assistance is unavailable; or |
|---|
| 45 | 45 | | (3) $5 [$2] million. |
|---|
| 46 | 46 | | (c) If the local governmental entity demonstrates to the |
|---|
| 47 | 47 | | commission that, because of a limited budget, the entity lacks the |
|---|
| 48 | 48 | | resources necessary to provide 50 percent of the amount of matching |
|---|
| 49 | 49 | | money or investment that the entity is required to provide, the |
|---|
| 50 | 50 | | commission may make a grant in an amount of not more than 80 percent |
|---|
| 51 | 51 | | of the amount of that matching money or investment requirement but |
|---|
| 52 | 52 | | may not make a grant in an amount that exceeds $5 [$2] million. |
|---|
| 53 | 53 | | (e) The commission may make a grant to an eligible local |
|---|
| 54 | 54 | | governmental entity for a project described by Subsection (a)(4) in |
|---|
| 55 | 55 | | an amount that does not exceed the lesser of 10 percent of the total |
|---|
| 56 | 56 | | construction cost of the project or $5 million. |
|---|
| 57 | 57 | | SECTION 2. This Act takes effect September 1, 2015. |
