9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 8 | | SECTION 1. Section 1001.201, Health and Safety Code, as |
---|
11 | 9 | | added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature, |
---|
12 | 10 | | Regular Session, 2013, is amended by adding Subdivisions (4) and |
---|
13 | 11 | | (5) to read as follows: |
---|
14 | 12 | | (4) "School district employee" means a person employed |
---|
15 | 13 | | by a school district who regularly interacts with students through |
---|
16 | 14 | | the course of the person's duties, including an educator, a |
---|
17 | 15 | | secretary, a school bus driver, or a cafeteria worker. |
---|
18 | 16 | | (5) "School resource officer" has the meaning assigned |
---|
19 | 17 | | by Section 1701.601, Occupations Code. |
---|
20 | 18 | | SECTION 2. Subchapter H, Chapter 1001, Health and Safety |
---|
21 | 19 | | Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd |
---|
22 | 20 | | Legislature, Regular Session, 2013, is amended by adding Section |
---|
23 | 21 | | 1001.2015 to read as follows: |
---|
24 | 22 | | Sec. 1001.2015. LIMITATION ON GRANTS. For each state |
---|
25 | 23 | | fiscal year, the department may give to a local mental health |
---|
26 | 24 | | authority in the form of grants under Sections 1001.202 and |
---|
27 | 25 | | 1001.203 an amount that may not exceed the lesser of: |
---|
28 | 26 | | (1) three percent of the total amount appropriated to |
---|
29 | 27 | | the department for making grants under those sections; or |
---|
30 | 28 | | (2) $70,000. |

31 | 29 | | SECTION 3. Section 1001.202(b), Health and Safety Code, as |
---|
32 | 30 | | added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature, |
---|
33 | 31 | | Regular Session, 2013, is amended to read as follows: |
---|
34 | 32 | | (b) The [Except as provided by Subsection (c), the] |
---|
35 | 33 | | department shall make each grant to a local mental health authority |
---|
36 | 34 | | under this section in an amount equal to $1,000 times the number of |
---|
37 | 35 | | employees or contractors of the authority whose training as mental |
---|
38 | 36 | | health first aid trainers will be paid by the grant. |
---|
39 | 37 | | SECTION 4. Sections 1001.203(a) and (c), Health and Safety |
---|
40 | 38 | | Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd |
---|
41 | 39 | | Legislature, Regular Session, 2013, are amended to read as follows: |
---|
42 | 40 | | (a) To the extent funds are appropriated to the department |
---|
43 | 41 | | for that purpose, the department shall make grants to local mental |
---|
44 | 42 | | health authorities to provide an approved mental health first aid |
---|
45 | 43 | | training program, administered by mental health first aid trainers, |
---|
46 | 44 | | at no cost to school district employees and school resource |
---|
47 | 45 | | officers [educators]. |
---|
48 | 46 | | (c) The [Subject to the limit provided by Subsection (b), |
---|
49 | 47 | | out of the funds appropriated to the department for making grants |
---|
50 | 48 | | under this section, the] department shall grant $100 to a local |
---|
51 | 49 | | mental health authority for each school district employee or school |
---|
52 | 50 | | resource officer [educator] who successfully completes a mental |
---|
53 | 51 | | health first aid training program provided by the authority under |
---|
54 | 52 | | this section. |
---|
55 | 53 | | SECTION 5. Subchapter H, Chapter 1001, Health and Safety |
---|
56 | 54 | | Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd |
---|
57 | 55 | | Legislature, Regular Session, 2013, is amended by adding Section |
---|
58 | 56 | | 1001.2031 to read as follows: |
---|
59 | 57 | | Sec. 1001.2031. SUPPLEMENTAL GRANTS FOR TRAINING CERTAIN |
---|
60 | 58 | | EDUCATORS IN MENTAL HEALTH FIRST AID. For each state fiscal year, |
---|
61 | 59 | | the department may allocate any unobligated money appropriated for |
---|
62 | 60 | | making grants under Sections 1001.202 and 1001.203 for supplemental |
---|
63 | 61 | | grants. The department may give a supplemental grant to a local |
---|
64 | 62 | | mental health authority that submits to the department a revised |
---|
65 | 63 | | plan as provided under Section 1001.204 that demonstrates how the |
---|
66 | 64 | | additional grant money would be used if made available to the |
---|
67 | 65 | | authority. |
---|
68 | 66 | | SECTION 6. Section 1001.204(a), Health and Safety Code, as |
---|
69 | 67 | | added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature, |
---|
70 | 68 | | Regular Session, 2013, is amended to read as follows: |
---|
71 | 69 | | (a) Not later than July [October] 1 of each state fiscal |
---|
72 | 70 | | year for which a local mental health authority will seek a grant |
---|
73 | 71 | | from the department under Section 1001.203, the authority shall |
---|
74 | 72 | | submit to the department a plan demonstrating the manner in which |
---|
75 | 73 | | grants made to the authority under that section will be used: |
---|
76 | 74 | | (1) to train individuals in mental health first aid |
---|
77 | 75 | | throughout the authority's local service area to maximize the |
---|
78 | 76 | | number of children who have direct contact with an individual who |
---|
79 | 77 | | has successfully completed a mental health first aid training |
---|
80 | 78 | | program provided by the authority; |
---|
81 | 79 | | (2) to meet the greatest needs of the authority's local |
---|
82 | 80 | | service area, as identified by the authority; and |
---|
83 | 81 | | (3) to complement existing resources and not duplicate |
---|
84 | 82 | | established mental health first aid training efforts. |
---|
85 | 83 | | SECTION 7. Section 1001.205, Health and Safety Code, as |
---|
86 | 84 | | added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature, |
---|
87 | 85 | | Regular Session, 2013, is amended to read as follows: |
---|
88 | 86 | | Sec. 1001.205. REPORTS. (a) Not later than September 30 |
---|
89 | 87 | | [July 1] of each year, a local mental health authority shall provide |
---|
90 | 88 | | to the department the number of: |
---|
91 | 89 | | (1) employees and contractors of the authority who |
---|
92 | 90 | | were trained as mental health first aid trainers under Section |
---|
93 | 91 | | 1001.202 during the preceding fiscal year; |
---|
94 | 92 | | (2) educators, school district employees other than |
---|
95 | 93 | | educators, and school resource officers who completed a mental |
---|
96 | 94 | | health first aid training program offered by the authority under |
---|
97 | 95 | | Section 1001.203 during the preceding fiscal [calendar] year; and |
---|
98 | 96 | | (3) individuals who are not school district employees |
---|
99 | 97 | | or school resource officers [educators] who completed a mental |
---|
100 | 98 | | health first aid training program offered by the authority during |
---|
101 | 99 | | the preceding fiscal [calendar] year. |
---|
102 | 100 | | (b) Not later than December 1 [August 1] of each year, the |
---|
103 | 101 | | department shall compile the information submitted by local mental |
---|
104 | 102 | | health authorities as required by Subsection (a) and submit a |
---|
105 | 103 | | report to the legislature containing the number of: |
---|
106 | 104 | | (1) authority employees and contractors trained as |
---|
107 | 105 | | mental health first aid trainers during the preceding fiscal year; |
---|
108 | 106 | | (2) educators, school district employees other than |
---|
109 | 107 | | educators, and school resource officers who completed a mental |
---|
110 | 108 | | health first aid training program provided by an authority during |
---|
111 | 109 | | the preceding fiscal [calendar] year; and |
---|
112 | 110 | | (3) individuals who are not school district employees |
---|
113 | 111 | | or school resource officers [educators] who completed a mental |
---|
114 | 112 | | health first aid training program provided by an authority during |
---|
115 | 113 | | the preceding fiscal [calendar] year. |
---|
116 | 114 | | SECTION 8. The following are repealed: |
---|
117 | 115 | | (1) Section 1001.202(c), Health and Safety Code, as |
---|
118 | 116 | | added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature, |
---|
119 | 117 | | Regular Session, 2013; and |
---|
120 | 118 | | (2) Section 1001.203(b), Health and Safety Code, as |
---|
121 | 119 | | added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature, |
---|
122 | 120 | | Regular Session, 2013. |
---|
123 | 121 | | SECTION 9. This Act takes effect immediately if it receives |
---|
124 | 122 | | a vote of two-thirds of all the members elected to each house, as |
---|
125 | 123 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
126 | 124 | | Act does not receive the vote necessary for immediate effect, this |
---|
127 | 125 | | Act takes effect September 1, 2015. |
