64 AN ACT
75 relating to mental health first aid training for school district
86 employees and school resource officers.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 1001.201, Health and Safety Code, as
119 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
1210 Regular Session, 2013, is amended by adding Subdivisions (4) and
1311 (5) to read as follows:
1412 (4) "School district employee" means a person employed
1513 by a school district who regularly interacts with students through
1614 the course of the person's duties, including an educator, a
1715 secretary, a school bus driver, or a cafeteria worker.
1816 (5) "School resource officer" has the meaning assigned
1917 by Section 1701.601, Occupations Code.
2018 SECTION 2. Subchapter H, Chapter 1001, Health and Safety
2119 Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd
2220 Legislature, Regular Session, 2013, is amended by adding Section
2321 1001.2015 to read as follows:
2422 Sec. 1001.2015. LIMITATION ON GRANTS. For each state
2523 fiscal year, the department may give to a local mental health
2624 authority in the form of grants under Sections 1001.202 and
2725 1001.203 an amount that may not exceed the lesser of:
2826 (1) three percent of the total amount appropriated to
2927 the department for making grants under those sections; or
3028 (2) $70,000.
3129 SECTION 3. Section 1001.202(b), Health and Safety Code, as
3230 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
3331 Regular Session, 2013, is amended to read as follows:
3432 (b) The [Except as provided by Subsection (c), the]
3533 department shall make each grant to a local mental health authority
3634 under this section in an amount equal to $1,000 times the number of
3735 employees or contractors of the authority whose training as mental
3836 health first aid trainers will be paid by the grant.
3937 SECTION 4. Sections 1001.203(a) and (c), Health and Safety
4038 Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd
4139 Legislature, Regular Session, 2013, are amended to read as follows:
4240 (a) To the extent funds are appropriated to the department
4341 for that purpose, the department shall make grants to local mental
4442 health authorities to provide an approved mental health first aid
4543 training program, administered by mental health first aid trainers,
4644 at no cost to school district employees and school resource
4745 officers [educators].
4846 (c) The [Subject to the limit provided by Subsection (b),
4947 out of the funds appropriated to the department for making grants
5048 under this section, the] department shall grant $100 to a local
5149 mental health authority for each school district employee or school
5250 resource officer [educator] who successfully completes a mental
5351 health first aid training program provided by the authority under
5452 this section.
5553 SECTION 5. Subchapter H, Chapter 1001, Health and Safety
5654 Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd
5755 Legislature, Regular Session, 2013, is amended by adding Section
5856 1001.2031 to read as follows:
5957 Sec. 1001.2031. SUPPLEMENTAL GRANTS FOR TRAINING CERTAIN
6058 EDUCATORS IN MENTAL HEALTH FIRST AID. For each state fiscal year,
6159 the department may allocate any unobligated money appropriated for
6260 making grants under Sections 1001.202 and 1001.203 for supplemental
6361 grants. The department may give a supplemental grant to a local
6462 mental health authority that submits to the department a revised
6563 plan as provided under Section 1001.204 that demonstrates how the
6664 additional grant money would be used if made available to the
6765 authority.
6866 SECTION 6. Section 1001.204(a), Health and Safety Code, as
6967 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
7068 Regular Session, 2013, is amended to read as follows:
7169 (a) Not later than July [October] 1 of each state fiscal
7270 year for which a local mental health authority will seek a grant
7371 from the department under Section 1001.203, the authority shall
7472 submit to the department a plan demonstrating the manner in which
7573 grants made to the authority under that section will be used:
7674 (1) to train individuals in mental health first aid
7775 throughout the authority's local service area to maximize the
7876 number of children who have direct contact with an individual who
7977 has successfully completed a mental health first aid training
8078 program provided by the authority;
8179 (2) to meet the greatest needs of the authority's local
8280 service area, as identified by the authority; and
8381 (3) to complement existing resources and not duplicate
8482 established mental health first aid training efforts.
8583 SECTION 7. Section 1001.205, Health and Safety Code, as
8684 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
8785 Regular Session, 2013, is amended to read as follows:
8886 Sec. 1001.205. REPORTS. (a) Not later than September 30
8987 [July 1] of each year, a local mental health authority shall provide
9088 to the department the number of:
9189 (1) employees and contractors of the authority who
9290 were trained as mental health first aid trainers under Section
9391 1001.202 during the preceding fiscal year;
9492 (2) educators, school district employees other than
9593 educators, and school resource officers who completed a mental
9694 health first aid training program offered by the authority under
9795 Section 1001.203 during the preceding fiscal [calendar] year; and
9896 (3) individuals who are not school district employees
9997 or school resource officers [educators] who completed a mental
10098 health first aid training program offered by the authority during
10199 the preceding fiscal [calendar] year.
102100 (b) Not later than December 1 [August 1] of each year, the
103101 department shall compile the information submitted by local mental
104102 health authorities as required by Subsection (a) and submit a
105103 report to the legislature containing the number of:
106104 (1) authority employees and contractors trained as
107105 mental health first aid trainers during the preceding fiscal year;
108106 (2) educators, school district employees other than
109107 educators, and school resource officers who completed a mental
110108 health first aid training program provided by an authority during
111109 the preceding fiscal [calendar] year; and
112110 (3) individuals who are not school district employees
113111 or school resource officers [educators] who completed a mental
114112 health first aid training program provided by an authority during
115113 the preceding fiscal [calendar] year.
116114 SECTION 8. The following are repealed:
117115 (1) Section 1001.202(c), Health and Safety Code, as
118116 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
119117 Regular Session, 2013; and
120118 (2) Section 1001.203(b), Health and Safety Code, as
121119 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
122120 Regular Session, 2013.
123121 SECTION 9. This Act takes effect immediately if it receives
124122 a vote of two-thirds of all the members elected to each house, as
125123 provided by Section 39, Article III, Texas Constitution. If this
126124 Act does not receive the vote necessary for immediate effect, this
127125 Act takes effect September 1, 2015.
