55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the period after which a governmental entity must
88 execute an expunction order.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 5(a) and (f), Article 55.02, Code of
1111 Criminal Procedure, are amended to read as follows:
1212 (a) Except as provided by Subsections (f) and (g), on
1313 receipt of the order and after the court's plenary power expires,
1414 any post-judgment activity in the case is resolved, and the
1515 disposition of the case becomes final, each official or agency or
1616 other governmental entity named in the order shall:
1717 (1) return all records and files that are subject to
1818 the expunction order to the court or in cases other than those
1919 described by Section 1a, if removal is impracticable, obliterate
2020 all portions of the record or file that identify the person who is
2121 the subject of the order and notify the court of its action; and
2222 (2) delete from its public records all index
2323 references to the records and files that are subject to the
2424 expunction order.
2525 (f) On receipt of an order granting expunction to a person
2626 entitled to expunction under Article 55.01(d) and after the court's
2727 plenary power expires, any post-judgment activity in the case is
2828 resolved, and the disposition of the case becomes final, each
2929 official, agency, or other governmental entity named in the order:
3030 (1) shall:
3131 (A) obliterate all portions of the record or file
3232 that identify the petitioner; and
3333 (B) substitute for all obliterated portions of
3434 the record or file any available information that identifies the
3535 person arrested; and
3636 (2) may not return the record or file or delete index
3737 references to the record or file.
3838 SECTION 2. This Act takes effect September 1, 2015.
