10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 9 | | SECTION 1. Section 134.001, Education Code, is amended by |
---|
12 | 10 | | adding Subdivision (1) to read as follows: |
---|
13 | 11 | | (1) "Commission" means the Texas Workforce |
---|
14 | 12 | | Commission. |
---|
15 | 13 | | SECTION 2. Section 134.002(a), Education Code, is amended |
---|
16 | 14 | | to read as follows: |
---|
17 | 15 | | (a) The commission [comptroller] shall establish and |
---|
18 | 16 | | administer the Jobs and Education for Texans (JET) fund as a |
---|
19 | 17 | | dedicated account in the general revenue fund. |
---|
20 | 18 | | SECTION 3. Section 134.003, Education Code, is amended to |
---|
21 | 19 | | read as follows: |
---|
22 | 20 | | Sec. 134.003. ADVISORY BOARD. (a) An advisory board of |
---|
23 | 21 | | education and workforce stakeholders is created to assist the |
---|
24 | 22 | | commission [comptroller] in administering this chapter. |
---|
25 | 23 | | (b) The advisory board is composed of six [seven] members |
---|
26 | 24 | | who serve two-year terms and are appointed as follows: |
---|
27 | 25 | | (1) one member appointed by the governor; |
---|
28 | 26 | | (2) one member appointed by the lieutenant governor; |
---|
29 | 27 | | (3) one member appointed by the speaker of the house of |
---|
30 | 28 | | representatives; |
---|
31 | 29 | | (4) one member appointed by the Texas Higher Education |
---|
32 | 30 | | Coordinating Board; |
---|
33 | 31 | | (5) one member appointed by the commission [Texas |
---|
34 | 32 | | Workforce Commission]; and |
---|
35 | 33 | | (6) the chair of the commission [one member of the |
---|
36 | 34 | | public appointed by the comptroller; and |
---|
37 | 35 | | [(7) the comptroller], who serves as the presiding |
---|
38 | 36 | | officer. |
---|
39 | 37 | | (c) The advisory board shall meet at least once each |
---|
40 | 38 | | quarter, or as needed, to review received applications and |
---|
41 | 39 | | recommend awarding grants under this chapter. |
---|
42 | 40 | | SECTION 4. Section 134.004(a), Education Code, is amended |
---|
43 | 41 | | to read as follows: |
---|
44 | 42 | | (a) The commission [comptroller] shall establish and |
---|
45 | 43 | | administer the Jobs and Education for Texans (JET) Grant Program to |
---|
46 | 44 | | provide grants to public junior colleges and public technical |
---|
47 | 45 | | institutes that apply to the advisory board in the manner |
---|
48 | 46 | | prescribed by the advisory board. The commission [comptroller] |
---|
49 | 47 | | shall award the grants on the advice and recommendations of the |
---|
50 | 48 | | advisory board. |
---|
51 | 49 | | SECTION 5. Sections 134.006(a), (c), and (d), Education |
---|
52 | 50 | | Code, are amended to read as follows: |
---|
53 | 51 | | (a) The commission [comptroller] may award a grant for the |
---|
54 | 52 | | development of new career and technical education courses or |
---|
55 | 53 | | programs at public junior colleges and public technical institutes. |
---|
56 | 54 | | (c) In awarding a grant under this section, the commission |
---|
57 | 55 | | [comptroller] shall primarily consider the potential economic |
---|
58 | 56 | | returns to the state from the development of the career and |
---|
59 | 57 | | technical education course or program. The commission |
---|
60 | 58 | | [comptroller] may also consider whether the course or program: |
---|
61 | 59 | | (1) is part of a new, emerging industry or high-demand |
---|
62 | 60 | | occupation; |
---|
63 | 61 | | (2) offers new or expanded dual credit career and |
---|
64 | 62 | | technical educational opportunities in public high schools; or |
---|
65 | 63 | | (3) is provided in cooperation with other public |
---|
66 | 64 | | junior colleges or public technical institutes across existing |
---|
67 | 65 | | service areas. |
---|
68 | 66 | | (d) To be eligible to receive a grant under this section, a |
---|
69 | 67 | | public junior college or public technical institute must provide |
---|
70 | 68 | | matching funds in accordance with rules adopted under Section |
---|
71 | 69 | | 134.008. The matching funds may be obtained from any source |
---|
72 | 70 | | available to the junior college or technical institute, including |
---|
73 | 71 | | [in-kind contributions,] industry consortia, community or |
---|
74 | 72 | | foundation grants, individual contributions, and local |
---|
75 | 73 | | governmental agency operating funds. |
---|
76 | 74 | | SECTION 6. Section 134.008, Education Code, is amended to |
---|
77 | 75 | | read as follows: |
---|
78 | 76 | | Sec. 134.008. RULES. The commission [comptroller] shall |
---|
79 | 77 | | adopt rules as necessary for the administration of this chapter. |
---|
80 | 78 | | SECTION 7. (a) Not later than September 1, 2015: |
---|
81 | 79 | | (1) the administration of the Jobs and Education for |
---|
82 | 80 | | Texans Grant Program shall be transferred from the comptroller of |
---|
83 | 81 | | public accounts to the Texas Workforce Commission; |
---|
84 | 82 | | (2) all rules, forms, policies, procedures, or |
---|
85 | 83 | | decisions of the comptroller that are related to the Jobs and |
---|
86 | 84 | | Education for Texans Grant Program are continued in effect as |
---|
87 | 85 | | rules, forms, policies, procedures, or decisions of the Texas |
---|
88 | 86 | | Workforce Commission until superseded by a rule or other |
---|
89 | 87 | | appropriate act of the Texas Workforce Commission; |
---|
90 | 88 | | (3) all money, obligations, memoranda of |
---|
91 | 89 | | understanding, leases, rights, and contracts, including grant |
---|
92 | 90 | | agreements, of the comptroller related to the Jobs and Education |
---|
93 | 91 | | for Texans Grant Program are transferred to the Texas Workforce |
---|
94 | 92 | | Commission, and the Texas Workforce Commission assumes, without a |
---|
95 | 93 | | change in status, the position of the comptroller in all |
---|
96 | 94 | | transferred contracts, including grant agreements, related to the |
---|
97 | 95 | | Jobs and Education for Texans Grant Program; |
---|
98 | 96 | | (4) records in the custody of the comptroller related |
---|
99 | 97 | | to the Jobs and Education for Texans Grant Program are transferred |
---|
100 | 98 | | to and become the property of the Texas Workforce Commission; and |
---|
101 | 99 | | (5) a reference in law or administrative rule to the |
---|
102 | 100 | | comptroller relating to the administration of the Jobs and |
---|
103 | 101 | | Education for Texans Grant Program means the Texas Workforce |
---|
104 | 102 | | Commission. |
---|
105 | 103 | | (b) Before the transfer of the administration of the Jobs |
---|
106 | 104 | | and Education for Texans Grant Program, the comptroller of public |
---|
107 | 105 | | accounts and the Texas Workforce Commission shall coordinate the |
---|
108 | 106 | | transfer of powers and duties, including records, appropriations, |
---|
109 | 107 | | disbursements, compliance audits, monitoring and enforcement, and |
---|
110 | 108 | | other items, to ensure a smooth transition. |
---|
111 | 109 | | SECTION 8. This Act takes effect immediately if it receives |
---|
112 | 110 | | a vote of two-thirds of all the members elected to each house, as |
---|
113 | 111 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
114 | 112 | | Act does not receive the vote necessary for immediate effect, this |
---|
115 | 113 | | Act takes effect September 1, 2015. |
