55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the duties of the county attorney in Aransas County and
88 to the duties of the district attorney for the 36th Judicial
99 District.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.122, Government Code, is amended to
1212 read as follows:
1313 Sec. 43.122. 36TH JUDICIAL DISTRICT. The voters of
1414 [Aransas and] San Patricio County [counties] elect a district
1515 attorney for the 36th Judicial District who represents the state in
1616 that district court only in that county [those counties]. In
1717 addition to exercising the duties and authority conferred on
1818 district attorneys by general law, the district attorney represents
1919 the state in all criminal cases in the district courts in that
2020 county [those counties].
2121 SECTION 2. Subchapter B, Chapter 45, Government Code, is
2222 amended by adding Section 45.104 to read as follows:
2323 Sec. 45.104. ARANSAS COUNTY. (a) In Aransas County, the
2424 county attorney of Aransas County shall perform the duties imposed
2525 on and have the powers conferred on district attorneys by general
2626 law.
2727 (b) The county attorney of Aransas County or the
2828 Commissioners Court of Aransas County may accept gifts or grants
2929 from any individual, partnership, corporation, trust, foundation,
3030 association, or governmental entity for the purpose of financing or
3131 assisting the operation of the office of county attorney in Aransas
3232 County. The county attorney shall account for and report to the
3333 commissioners court all gifts or grants accepted under this
3434 subsection.
3535 SECTION 3. This Act takes effect September 1, 2015.
