| 7 | 7 | | relating to the duties of the county attorney in Aransas County and |

| 8 | 8 | | to the duties of the district attorney for the 36th Judicial |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 43.122, Government Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 43.122. 36TH JUDICIAL DISTRICT. The voters of |
|---|
| 14 | 14 | | [Aransas and] San Patricio County [counties] elect a district |
|---|
| 15 | 15 | | attorney for the 36th Judicial District who represents the state in |
|---|
| 16 | 16 | | that district court only in that county [those counties]. In |
|---|
| 17 | 17 | | addition to exercising the duties and authority conferred on |
|---|
| 18 | 18 | | district attorneys by general law, the district attorney represents |
|---|
| 19 | 19 | | the state in all criminal cases in the district courts in that |
|---|
| 20 | 20 | | county [those counties]. |

| 21 | 21 | | SECTION 2. Subchapter B, Chapter 45, Government Code, is |
|---|
| 22 | 22 | | amended by adding Section 45.104 to read as follows: |
|---|
| 23 | 23 | | Sec. 45.104. ARANSAS COUNTY. (a) In Aransas County, the |
|---|
| 24 | 24 | | county attorney of Aransas County shall perform the duties imposed |
|---|
| 25 | 25 | | on and have the powers conferred on district attorneys by general |
|---|
| 26 | 26 | | law. |
|---|
| 27 | 27 | | (b) The county attorney of Aransas County or the |
|---|
| 28 | 28 | | Commissioners Court of Aransas County may accept gifts or grants |
|---|
| 29 | 29 | | from any individual, partnership, corporation, trust, foundation, |
|---|
| 30 | 30 | | association, or governmental entity for the purpose of financing or |
|---|
| 31 | 31 | | assisting the operation of the office of county attorney in Aransas |
|---|
| 32 | 32 | | County. The county attorney shall account for and report to the |
|---|
| 33 | 33 | | commissioners court all gifts or grants accepted under this |
|---|
| 34 | 34 | | subsection. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2015. |
