64 AN ACT
75 relating to the allocation to the Parks and Wildlife Department of
86 the proceeds from taxes imposed on the sale, storage, or use of
97 sporting goods.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 11.035(b), Parks and Wildlife Code, is
1210 amended to read as follows:
1311 (b) The department shall deposit to the credit of the state
1412 parks account all revenue, less allowable costs, received from the
1513 following sources:
1614 (1) grants or operation of concessions in state parks
1715 or fishing piers;
1816 (2) publications on state parks, state historic sites,
1917 or state scientific areas;
2018 (3) fines or penalties received from violations of
2119 regulations governing parks issued pursuant to Subchapter B,
2220 Chapter 13;
2321 (4) fees and revenue collected under Section 11.027(b)
2422 or (c) that are associated with state park lands;
2523 (5) [an amount of money equal to 74 percent of the]
2624 credits made to the department under Section 151.801, Tax Code, in
2725 an amount not to exceed the amount of the tax proceeds appropriated
2826 from the account for use during the then-current state fiscal
2927 biennium plus the amount necessary to fund the cost of state
3028 contributions for benefits of department employees whose salaries
3129 or wages are paid from the account; and
3230 (6) any other source provided by law.
3331 SECTION 2. Section 11.043(b), Parks and Wildlife Code, is
3432 amended to read as follows:
3533 (b) The account consists of:
3634 (1) [the amount of] credits made to the department
3735 under Section 151.801, Tax Code, in an amount not to exceed the
3836 amount of the tax proceeds appropriated from the account for use
3937 during the then-current state fiscal biennium plus the amount
4038 necessary to fund the cost of state contributions for benefits of
4139 department employees whose salaries or wages are paid from the
4240 account [after allocations to:
4341 [(A) the state parks account;
4442 [(B) the large county and municipality
4543 recreation and parks account; and
4644 [(C) the Texas recreation and parks account];
4745 (2) proceeds of revenue bonds issued under Section
4846 13.0045; and
4947 (3) money from any other source authorized by law.
5048 SECTION 3. Section 24.003(a), Parks and Wildlife Code, is
5149 amended to read as follows:
5250 (a) The department shall deposit to the credit of the Texas
5351 recreation and parks account:
5452 (1) [an amount of money equal to 15 percent of the]
5553 credits made to the department under Section 151.801, Tax Code, in
5654 an amount not to exceed the amount of the tax proceeds appropriated
5755 from the account for use during the then-current state fiscal
5856 biennium plus the amount necessary to fund the cost of state
5957 contributions for benefits of department employees whose salaries
6058 or wages are paid from the account; and
6159 (2) money from any other source authorized by law.
6260 SECTION 4. Section 24.053(a), Parks and Wildlife Code, is
6361 amended to read as follows:
6462 (a) The department shall deposit to the credit of the large
6563 county and municipality recreation and parks account:
6664 (1) [an amount of money equal to 10 percent of the]
6765 credits made to the department under Section 151.801, Tax Code, in
6866 an amount not to exceed the amount of the tax proceeds appropriated
6967 from the account for use during the then-current state fiscal
7068 biennium plus the amount necessary to fund the cost of state
7169 contributions for benefits of department employees whose salaries
7270 or wages are paid from the account; and
7371 (2) money from any other source authorized by law.
7472 SECTION 5. Section 151.801(c), Tax Code, is amended to read
7573 as follows:
7674 (c) The [Subject to Subsection (c-1), the] proceeds from the
7775 collection of the taxes imposed by this chapter on the sale,
7876 storage, or use of sporting goods shall be deposited as follows:
7977 (1) an amount equal to 94 percent of the proceeds shall
8078 be credited to the Parks and Wildlife Department and deposited as
8179 specified in the Parks and Wildlife Code; and
8280 (2) an amount equal to six percent of the proceeds
8381 shall be credited to the Texas Historical Commission and deposited
8482 as specified in Section 442.073, Government Code.
8583 SECTION 6. Section 151.801(c-1), Tax Code, is repealed.
8684 SECTION 7. This Act takes effect September 1, 2015.
