55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring that certain strategic plans of certain state
88 agencies include the goals of reducing the incidence of food
99 insecurity, poor nutrition, and diet-related disease in this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 12, Agriculture Code, is amended by
1212 adding Section 12.00251 to read as follows:
1313 Sec. 12.00251. GOALS OF ADDRESSING FOOD INSECURITY, POOR
1414 NUTRITION, AND DIET-RELATED DISEASE; INCLUSION IN STRATEGIC PLAN.
1515 (a) The department shall include in the department's strategic
1616 plan required under Chapter 2056, Government Code, the goals of
1717 reducing the incidence of food insecurity, poor nutrition, and
1818 diet-related disease in this state by:
1919 (1) increasing access to nutritious foods by persons
2020 in this state;
2121 (2) maximizing federal funds received under child
2222 nutrition programs, including the national free or reduced-price
2323 lunch program established under 42 U.S.C. Section 1751 et seq., by
2424 increasing:
2525 (A) the efficiency of the programs; and
2626 (B) access to the programs by persons eligible
2727 for the programs;
2828 (3) strengthening the department's education
2929 initiatives to increase awareness of food and nutrition programs
3030 available in this state; and
3131 (4) facilitating obesity prevention and diabetes
3232 awareness initiatives.
3333 (b) The goals required under Subsection (a) must include
3434 specific targets for increasing participation in nutrition
3535 programs administered by the department.
3636 (c) The department shall seek input from food insecurity
3737 experts, service providers, and other stakeholders in developing
3838 the goals required under Subsection (a).
3939 SECTION 2. Subchapter B, Chapter 7, Education Code, is
4040 amended by adding Section 7.041 to read as follows:
4141 Sec. 7.041. GOALS OF ADDRESSING FOOD INSECURITY, POOR
4242 NUTRITION, AND DIET-RELATED DISEASE; INCLUSION IN STRATEGIC PLAN.
4343 (a) The agency shall include in the agency's strategic plan
4444 required under Chapter 2056, Government Code, the goals of reducing
4545 the incidence of food insecurity, poor nutrition, and diet-related
4646 disease in this state by:
4747 (1) increasing access to nutritious foods by persons
4848 served by the agency;
4949 (2) maximizing federal funds received under child
5050 nutrition programs, including the national free or reduced-price
5151 lunch program established under 42 U.S.C. Section 1751 et seq., by
5252 increasing:
5353 (A) the efficiency of the programs; and
5454 (B) access to the programs by eligible persons
5555 served by the agency;
5656 (3) strengthening the agency's education initiatives
5757 to increase awareness of food and nutrition programs available in
5858 this state; and
5959 (4) facilitating obesity prevention and diabetes
6060 awareness initiatives.
6161 (b) The goals required under Subsection (a) must include
6262 specific targets for increasing participation in nutrition
6363 programs administered by the agency.
6464 (c) The agency shall seek input from food insecurity
6565 experts, service providers, and other stakeholders in developing
6666 the goals required under Subsection (a).
6767 SECTION 3. Section 531.022, Government Code, is amended by
6868 adding Subsections (f), (g), and (h) to read as follows:
6969 (f) In addition to the goals specified by Subsection (c),
7070 the plan must include as goals of the commission, the Department of
7171 Assistive and Rehabilitative Services, the Department of Aging and
7272 Disability Services, and the Department of State Health Services
7373 reducing the incidence of food insecurity, poor nutrition, and
7474 diet-related disease in this state by:
7575 (1) increasing access to nutritious foods by persons
7676 served by the agencies;
7777 (2) maximizing federal funds received under the
7878 special supplemental nutrition program for women, infants, and
7979 children and the supplemental nutrition assistance program by
8080 increasing the efficiency of the programs;
8181 (3) strengthening each agency's education initiatives
8282 to increase awareness of food and nutrition programs available in
8383 this state; and
8484 (4) facilitating obesity prevention and diabetes
8585 awareness initiatives.
8686 (g) The goals required under Subsection (f) must include
8787 specific targets for increasing participation in nutrition
8888 programs administered by the commission and other agencies
8989 described by that subsection.
9090 (h) The executive commissioner shall seek input from food
9191 insecurity experts, service providers, and other stakeholders in
9292 developing the goals required under Subsection (f).
9393 SECTION 4. In the first strategic plan under Chapter 2056,
9494 Government Code, issued after the effective date of this Act:
9595 (1) the Department of Agriculture shall, using
9696 existing funds, include in the plan the goals and methods of
9797 implementing the goals required by Section 12.00251(a),
9898 Agriculture Code, as added by this Act; and
9999 (2) the Texas Education Agency shall, using existing
100100 funds, include in the plan the goals and methods of implementing the
101101 goals required by Section 7.041(a), Education Code, as added by
102102 this Act.
103103 SECTION 5. The executive commissioner of the Health and
104104 Human Services Commission shall, using existing funds, include the
105105 goals and methods of implementing those goals specified by Section
106106 531.022(f), Government Code, as added by this Act, in the first
107107 biennial update of the coordinated strategic plan for health and
108108 human services required by Section 531.022, Government Code, as
109109 amended by this Act, that is required after the effective date of
110110 this Act.
111111 SECTION 6. This Act takes effect September 1, 2015.
