77 relating to natural disaster housing recovery.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 418, Government Code, is amended by
1010 adding Subchapter F-1 to read as follows:
1111 SUBCHAPTER F-1. NATURAL DISASTER HOUSING RECOVERY
1212 Sec. 418.131. DEFINITIONS. In this subchapter:
1313 (1) "Center" means the Hazard Reduction and Recovery
1414 Center at Texas A&M University.
1515 (2) "Local government" means a county, municipality,
1616 or council of government.
1717 (3) "Plan" means a local housing recovery plan
1818 developed under Section 418.133.
1919 Sec. 418.132. DUTIES OF GENERAL LAND OFFICE OR DESIGNATED
2020 STATE AGENCY. (a) Unless the governor designates a state agency
2121 under Subsection (d), the General Land Office shall receive and
2222 administer federal and state funds appropriated for long-term
2323 natural disaster recovery.
2424 (b) The General Land Office shall:
2525 (1) collaborate with the Texas Division of Emergency
2626 Management and the Federal Emergency Management Agency to secure
2727 reimbursement for housing needs in areas affected by natural
2828 disasters;
2929 (2) seek prior approval from the Federal Emergency
3030 Management Agency and the United States Department of Housing and
3131 Urban Development for the immediate post-disaster implementation
3232 of local housing recovery plans approved by the governor under
3333 Section 418.136; and
3434 (3) maintain a division with adequate staffing and
3535 other administrative support to carry out the General Land Office's
3636 duties relating to long-term natural disaster recovery.
3737 (c) The General Land Office may adopt rules as necessary to
3838 implement the General Land Office's duties under this subchapter.
3939 (d) The governor may designate a state agency to be
4040 responsible for long-term natural disaster recovery under this
4141 subchapter instead of the General Land Office. If the governor
4242 designates a state agency under this subsection, a reference to the
4343 General Land Office in this subchapter means the designated state
4444 agency.
4545 Sec. 418.133. LOCAL HOUSING RECOVERY PLAN. (a) A local
4646 government may develop and adopt a local housing recovery plan to
4747 provide for the rapid and efficient construction of permanent
4848 replacement housing following a natural disaster.
4949 (b) In developing the plan, a local government shall seek
5050 input from:
5151 (1) stakeholders in the community, including
5252 residents, local businesses, and community-based organizations;
5353 and
5454 (2) neighboring local governments.
5555 (c) A local government may submit a plan developed and
5656 adopted under Subsection (a) to the center for certification.
5757 Sec. 418.134. DUTIES OF HAZARD REDUCTION AND RECOVERY
5858 CENTER; PLAN CRITERIA AND CERTIFICATION. (a) The center shall
5959 review and certify plans submitted to the center by local
6060 governments.
6161 (b) The center shall establish criteria for certifying a
6262 plan. The center may not certify a plan unless the plan:
6363 (1) identifies areas in the local government's
6464 boundaries that are vulnerable to natural disasters;
6565 (2) identifies sources of post-disaster housing
6666 assistance and recovery funds;
6767 (3) provides procedures for rapidly responding to a
6868 natural disaster, including procedures for:
6969 (A) assessing and reporting housing damage,
7070 disaggregated by insured and uninsured losses, to the governor;
7171 (B) providing fair and efficient access to
7272 natural disaster recovery assistance for residents;
7373 (C) determining residents' eligibility for
7474 natural disaster recovery assistance;
7575 (D) educating residents about the rebuilding
7676 process and providing outreach and case management services; and
7777 (E) prequalifying and training local
7878 professionals needed for natural disaster recovery;
7979 (4) provides procedures to encourage residents to
8080 rebuild outside of the vulnerable areas identified under
8181 Subdivision (1);
8282 (5) provides procedures to maximize the use of local
8383 businesses, contractors, and supplies to rebuild to the extent
8484 possible;
8585 (6) provides procedures to maximize cost efficiency;
8686 (7) provides for the construction of permanent
8787 replacement housing for displaced residents as soon as possible
8888 after the natural disaster, with a goal of completion in not later
8989 than six months; and
9090 (8) complies with applicable state and federal law.
9191 (c) If the center determines that a plan does not meet the
9292 criteria prescribed by Subsection (b), the center shall identify
9393 the plan's deficiencies and assist the local government in revising
9494 the plan to meet the criteria.
9595 (d) The center shall provide training to local governments
9696 and community-based organizations on developing a plan. A local
9797 government that submits a plan to the center for certification
9898 under this section shall designate at least one representative to
9999 attend the center's training. The training must include
100100 information relating to:
101101 (1) previous experiences with housing recovery from
102102 natural disasters;
103103 (2) best practices for achieving rapid and efficient
104104 construction of permanent replacement housing;
105105 (3) federal and state laws and regulations on natural
106106 disaster recovery;
107107 (4) methods for identifying and planning for
108108 vulnerable areas and populations before a natural disaster; and
109109 (5) cost-effective land use and building practices.
110110 (e) The center shall create and maintain mapping and data
111111 resources related to natural disaster recovery and planning,
112112 including the Texas Coastal Communities Planning Atlas.
113113 (f) The center shall assist a local government on request in
114114 identifying areas that are vulnerable to natural disasters.
115115 (g) The center shall provide recommendations to the Texas
116116 Department of Insurance regarding the development of policies,
117117 procedures, and education programs to enable the quick and
118118 efficient reporting and settling of housing claims related to
119119 natural disasters.
120120 (h) The center may seek and accept gifts, grants, donations,
121121 and other funds to assist the center in fulfilling its duties under
122122 this section.
123123 Sec. 418.135. REVIEW OF LOCAL HOUSING RECOVERY PLAN BY
124124 GENERAL LAND OFFICE. (a) The center shall submit to the General
125125 Land Office a plan certified by the center under Section 418.134.
126126 (b) The General Land Office shall review the plan and
127127 consult with the center and the local government about any
128128 potential improvements the General Land Office may identify. In
129129 reviewing the plan, the General Land Office shall give deference to
130130 the local government regarding matters in the local government's
131131 discretion.
132132 (c) On completion of the review, the General Land Office
133133 shall accept the plan unless the General Land Office determines
134134 that the plan does not:
135135 (1) satisfy the criteria for a certified plan under
136136 Section 418.134(b);
137137 (2) provide for the rapid and efficient construction
138138 of permanent replacement housing; or
139139 (3) comply with applicable state and federal law.
140140 Sec. 418.136. APPROVAL BY GOVERNOR. (a) The General Land
141141 Office shall submit to the governor for approval or rejection a plan
142142 that the General Land Office accepts under Section 418.135.
143143 (b) If the governor rejects a plan, the governor must
144144 provide a written explanation of the reasons for the rejection.
145145 (c) A local government, in consultation with the center and
146146 the General Land Office, may revise a plan rejected by the governor
147147 under this section and resubmit the plan to the governor for
148148 approval.
149149 Sec. 418.137. EFFECT OF APPROVAL. (a) A plan approved by
150150 the governor under Section 418.136 is valid for four years and may
151151 be implemented during that period without further approval if a
152152 natural disaster occurs.
153153 (b) In accordance with rules adopted by the General Land
154154 Office, on or before expiration, the plan may be reviewed by the
155155 center and the General Land Office, updated if necessary, and
156156 resubmitted to the governor for approval or rejection.
157157 SECTION 2. This Act takes effect September 1, 2015.
