| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.052, Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended by amending Subsection (a) and adding Subsection (a-1) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) In addition to the activities authorized by Section |
|---|
| 14 | 14 | | 12.01, the holder of a brewer's permit whose annual production of |
|---|
| 15 | 15 | | ale together with the annual production of beer by the holder of a |
|---|
| 16 | 16 | | manufacturer's license at the same premises does not exceed a total |
|---|
| 17 | 17 | | of 225,000 barrels may sell ale produced on the brewer's premises |
|---|
| 18 | 18 | | under the permit to ultimate consumers on the brewer's premises: |
|---|
| 19 | 19 | | (1) for responsible consumption on the brewer's |
|---|
| 20 | 20 | | premises; or |
|---|
| 21 | 21 | | (2) subject to Subsection (a-1), for off-premises |
|---|
| 22 | 22 | | consumption. |
|---|
| 23 | 23 | | (a-1) Sales to consumers on the brewer's premises for |
|---|
| 24 | 24 | | off-premises consumption are limited to one purchase per consumer |
|---|
| 25 | 25 | | per month. The consumer's monthly purchase is limited to 576 fluid |
|---|
| 26 | 26 | | ounces of beer and ale combined. |

| 27 | 27 | | SECTION 2. Section 62.122, Alcoholic Beverage Code, is |
|---|
| 28 | 28 | | amended by amending Subsection (a) and adding Subsection (a-1) to |
|---|
| 29 | 29 | | read as follows: |
|---|
| 30 | 30 | | (a) A manufacturer's licensee whose annual production of |
|---|
| 31 | 31 | | beer together with the annual production of ale by the holder of a |
|---|
| 32 | 32 | | brewer's permit at the same premises does not exceed 225,000 |
|---|
| 33 | 33 | | barrels may sell beer produced on the manufacturer's premises under |
|---|
| 34 | 34 | | the license to ultimate consumers on the manufacturer's premises: |
|---|
| 35 | 35 | | (1) for responsible consumption on the manufacturer's |
|---|
| 36 | 36 | | premises; or |
|---|
| 37 | 37 | | (2) subject to Subsection (a-1), for off-premises |
