66 AN ACT
77 relating to the establishment of a rural resident physician grant
88 program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 61, Education Code, is amended by
1111 designating Section 61.511 as Subchapter I-1 and adding a heading
1212 to that subchapter to read as follows:
1313 SUBCHAPTER I-1. PHYSICIAN RESIDENCY GRANTS
1414 Sec. 61.511. RESIDENT PHYSICIAN EXPANSION GRANT PROGRAM.
1515 (a) The board shall administer the Resident Physician Expansion
1616 Grant Program as a competitive grant program to encourage the
1717 creation of new graduate medical education positions through
1818 community collaboration and innovative funding. The board shall
1919 award grants to physician residency programs at teaching hospitals
2020 and other appropriate health care entities according to the program
2121 criteria established under Subsections (b) and (i).
2222 (b) The board shall establish criteria for the grant program
2323 in consultation with the executive commissioner of the Health and
2424 Human Services Commission, with one or more physicians, teaching
2525 hospitals, medical schools, independent physician residency
2626 programs, and with other persons considered appropriate by the
2727 board. The program criteria must:
2828 (1) take into account the following factors:
2929 (A) the characteristics of existing residency
3030 positions that receive state funding;
3131 (B) current and projected physician workforce
3232 demographics; and
3333 (C) state population trends and projections; and
3434 (2) support the following goals:
3535 (A) creating new residency positions, with an
3636 emphasis on creating new first-year residency positions, without
3737 adversely affecting existing residency positions;
3838 (B) maximizing local or federal matching funds;
3939 (C) developing accredited physician residency
4040 programs at hospitals that have not previously offered residency
4141 programs; and
4242 (D) increasing residency positions with respect
4343 to:
4444 (i) medical specialties having shortages in
4545 this state; and
4646 (ii) medically underserved areas in this
4747 state.
4848 (c) The board may provide grants only to support a residency
4949 position that:
5050 (1) is created and accredited on or after January 1,
5151 2014; or
5252 (2) was created and accredited before January 1, 2013,
5353 but as of that date had not yet been filled.
5454 (d) A grant award may be used only to pay direct costs
5555 associated with the position, including the salary of the resident
5656 physician.
5757 (e) Each grant application must specify:
5858 (1) the number of residency positions expected to be
5959 created with the grant money; and
6060 (2) the grant amount requested for each year.
6161 (f) The board shall award grants for all residency positions
6262 awarded a grant under this section in the preceding year before
6363 awarding a grant for a residency position that did not receive a
6464 grant in the preceding year, provided that the applicable grant
6565 recipient from the preceding year complies with all conditions of
6666 the grant as described by Subsection (g).
6767 (g) The board shall monitor physician residency programs
6868 receiving grants as necessary to ensure compliance with the grant
6969 program and shall require the return of any unused grant money by,
7070 or shall decline to award additional grants to, a residency program
7171 that receives a grant but fails to:
7272 (1) create and fill, within a reasonable period, the
7373 number of residency positions proposed in the program's grant
7474 application; or
7575 (2) satisfy any other conditions of the grant imposed
7676 by the board.
7777 (h) The board shall use money forfeited under Subsection (g)
7878 to award grants to other eligible applicants. With respect to the
7979 physician residency program forfeiting the grant, the board may
8080 restore grant money or award additional grants, as applicable, to
8181 the program as soon as practicable after the program satisfies all
8282 conditions of the grant.
8383 (i) The board shall adopt rules for the administration of
8484 the grant program. The rules must include:
8585 (1) administrative provisions governing:
8686 (A) eligibility criteria for grant applicants;
8787 (B) grant application procedures;
8888 (C) guidelines relating to grant amounts;
8989 (D) guidelines relating to the number of grants
9090 to be awarded each year, subject to available funds;
9191 (E) procedures for evaluating grant
9292 applications; and
9393 (F) procedures for monitoring the use of grants;
9494 (2) methods for tracking the effectiveness of grants;
9595 and
9696 (3) any conditions relating to the receipt and use of a
9797 grant as considered appropriate by the board.
9898 (j) Not later than January 1 of each year, the board shall
9999 prepare and submit to the governor, the lieutenant governor, the
100100 speaker of the house of representatives, the standing committees of
101101 the senate and house of representatives with responsibility for
102102 oversight of health and human services issues, and the Legislative
103103 Budget Board a report that:
104104 (1) specifies each of the following with respect to
105105 the preceding program year:
106106 (A) the number of grants awarded under the
107107 program;
108108 (B) the amount of each grant awarded under the
109109 program;
110110 (C) the number of residency positions created
111111 with the support of grant money;
112112 (D) the medical specialty of the residency
113113 positions created; and
114114 (E) whether physicians who complete their
115115 training through residency positions created under the program
116116 choose to practice in this state and which medical specialties they
117117 choose for their practices; and
118118 (2) makes appropriate recommendations for legislative
119119 changes as necessary.
120120 SECTION 2. Subchapter I-1, Chapter 61, Education Code, as
121121 added by this Act, is amended by adding Section 61.512 to read as
122122 follows:
123123 Sec. 61.512. RURAL RESIDENT PHYSICIAN GRANT PROGRAM. (a)
124124 The board shall administer the Rural Resident Physician Grant
125125 Program as a competitive grant program to encourage the creation of
126126 new graduate medical education positions in rural and
127127 nonmetropolitan areas. The board shall award grants to new or
128128 expanded physician residency programs at teaching hospitals and
129129 other appropriate health care entities according to the program
130130 criteria established under Subsections (b) and (i).
131131 (b) The board shall establish criteria for the grant program
132132 in consultation with the executive commissioner of the Health and
133133 Human Services Commission, with one or more physicians, teaching
134134 hospitals, medical schools, and independent physician residency
135135 programs, and with other persons considered appropriate by the
136136 board. The program criteria must take into account whether a rural
137137 or nonmetropolitan area has the resources sufficient to support a
138138 physician residency program in a manner that would satisfy
139139 applicable residency accreditation requirements.
140140 (c) The board may provide grants only to support a physician
141141 residency program that provides the level of medical care that is
142142 most needed in a rural or nonmetropolitan area.
143143 (d) Grant funds awarded under this section may be used only
144144 to pay direct costs associated with creating or maintaining a
145145 residency position, including the salary of the resident physician.
146146 (e) Each grant application must specify:
147147 (1) the number of residency positions expected to be
148148 created or maintained with the grant money; and
149149 (2) the grant amount requested for each year.
150150 (f) The board shall award grants for all residency positions
151151 awarded a grant under this section in the preceding year before
152152 awarding a grant for a residency position that did not receive a
153153 grant in the preceding year, provided that the applicable grant
154154 recipient from the preceding year complies with all conditions of
155155 the grant as described by Subsection (g).
156156 (g) The board shall monitor physician residency programs
157157 receiving grants as necessary to ensure compliance with the grant
158158 program and shall require the return of any unused grant money by,
159159 or shall decline to award additional grants to, a residency program
160160 that receives a grant but fails to:
161161 (1) create and fill, within a reasonable period, the
162162 number of residency positions proposed in the program's grant
163163 application; or
164164 (2) satisfy any other conditions of the grant imposed

166166 (h) The board shall use money forfeited under Subsection (g)

174174 (1) administrative provisions governing:
175175 (A) eligibility criteria for grant applicants;
176176 (B) grant application procedures;
177177 (C) guidelines relating to grant amounts;
178178 (D) guidelines relating to the number of grants
179179 to be awarded each year, subject to available funds;
180180 (E) procedures for evaluating grant
181181 applications;
182182 (F) procedures for monitoring the use of grants;
183183 and
184184 (G) reporting requirements for grant recipients;
185185 (2) methods for tracking the effectiveness of grants;
186186 and
187187 (3) any conditions relating to the receipt and use of a
188188 grant as considered appropriate by the board.
189189 SECTION 3. (a) As soon as practicable after the effective
190190 date of this Act, the Texas Higher Education Coordinating Board
191191 shall adopt rules for the implementation and administration of the
192192 grant program established under Section 61.512, Education Code, as
193193 added by this Act. The board may adopt the initial rules in the
194194 manner provided by law for emergency rules.
195195 (b) Not later than October 1, 2015, the Texas Higher
196196 Education Coordinating Board shall establish the grant program
197197 required by Section 61.512, Education Code, as added by this Act,
198198 and shall begin to award grants under that program not later than
199199 January 1, 2016.
200200 SECTION 4. This Act takes effect immediately if it receives
201201 a vote of two-thirds of all the members elected to each house, as
202202 provided by Section 39, Article III, Texas Constitution. If this
203203 Act does not receive the vote necessary for immediate effect, this
204204 Act takes effect September 1, 2015.
