44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to abolishing the Music, Film, Television, and Multimedia
77 Office.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 444.030(b), Government Code, is amended
1010 to read as follows:
1111 (b) The commission shall enter into an agreement as required
1212 by Subsection (a) with the:
1313 (1) Texas [Central] Education Agency regarding the
1414 arts in education program in the public schools; and
1515 (2) office of the governor [Music, Film, Television,
1616 and Multimedia Office in the governor's office regarding work with
1717 the state's music and film industries; and
1818 [(3) Texas Department of Commerce], Texas Department
1919 of Transportation, and Parks and Wildlife Department regarding
2020 state tourism promotion efforts.
2121 SECTION 2. Section 2155.444(h), Government Code, is amended
2222 to read as follows:
2323 (h) The [Music, Film, Television, and Multimedia Office
2424 within the] office of the governor has exclusive rulemaking
2525 authority for purposes of:
2626 (1) determining whether an advertising campaign is
2727 subject to the requirements of this section;
2828 (2) establishing a bid process for purposes of the
2929 services described by Subsection (f); and
3030 (3) establishing criteria to determine whether a
3131 commercial production company or advertising agency is located in
3232 this state for the purposes of this section.
3333 SECTION 3. Section 2165.008(a)(1), Government Code, is
3434 amended to read as follows:
3535 (1) "Office" means the office of the governor [Music,
3636 Film, Television, and Multimedia Office].
3737 SECTION 4. Section 504.639(b), Transportation Code, is
3838 amended to read as follows:
3939 (b) After deduction of the department's administrative
4040 costs, the remainder of the fee for issuance of the license plates
4141 shall be deposited to the credit of the general revenue fund [Texas
4242 Music Foundation account established by Section 7.027, Education
4343 Code].
4444 SECTION 5. The following statutes are repealed:
4545 (1) Section 7.027, Education Code;
4646 (2) Section 403.029, Government Code;
4747 (3) Chapters 485 and 485A, Government Code; and
4848 (4) Sections 151.3185 and 151.3415, Tax Code.
4949 SECTION 6. On the effective date of this Act:
5050 (1) the Music, Film, Television, and Multimedia Office
5151 in the office of the governor is abolished;
5252 (2) all records and other property in the custody of
5353 the Music, Film, Television, and Multimedia Office are transferred
5454 to the office of the governor;
5555 (3) all unobligated and unexpended appropriations of
5656 the Music, Film, Television, and Multimedia Office lapse; and
5757 (4) all donations, gifts, and grants made to the
5858 Music, Film, Television, and Multimedia Office shall be transferred
5959 to the office of the governor to be used for purposes consistent
6060 with the mission of the former Music, Film, Television, and
6161 Multimedia Office.
6262 SECTION 7. This Act takes effect September 1, 2015.
