55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of an advisory committee to examine and
88 recommend a plan to increase the minimum age of juvenile
99 jurisdiction.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITION. In this Act, "board" means the Texas
1212 Juvenile Justice Board.
1313 SECTION 2. JUVENILE JURISDICTION ADVISORY COMMITTEE. Not
1414 later than December 1, 2015, the board shall appoint an advisory
1515 committee to develop a plan for raising the minimum age of a child
1616 subject to juvenile court jurisdiction from 10 years of age to 13
1717 years of age.
1818 SECTION 3. APPOINTMENTS; PRESIDING OFFICER. (a) In making
1919 appointments to the advisory committee, the board shall appoint
2020 members the board considers appropriate and who represent the
2121 geographic diversity of the state. The advisory committee must
2222 include:
2323 (1) one member from the Texas Juvenile Justice
2424 Department;
2525 (2) one member from the Department of State Health
2626 Services;
2727 (3) one member from the Health and Human Services
2828 Commission;
2929 (4) one member from the Texas Education Agency or who
3030 has expertise in education;
3131 (5) one member from the Legislative Budget Board with
3232 relevant expertise;
3333 (6) at least one member from the Department of Family
3434 and Protective Services;
3535 (7) at least three chief juvenile probation officers,
3636 including at least one chief juvenile probation officer from an
3737 urban county, one chief juvenile probation officer from a suburban
3838 county, and one chief juvenile probation officer from a rural
3939 county;
4040 (8) at least two members from local mental health
4141 authorities, including at least one member from an urban county and
4242 one member from a rural county;
4343 (9) a prosecutor with expertise in prosecuting
4444 juvenile offenders;
4545 (10) a defense attorney who specializes in juvenile
4646 defense;
4747 (11) a youth advocate;
4848 (12) private providers of youth services, including
4949 prevention services;
5050 (13) an individual with expertise in adolescent
5151 development or the impact of trauma on adolescents;
5252 (14) an individual who was involved with the juvenile
5353 justice system before the individual's thirteenth birthday or a
5454 parent of an individual who was involved with the juvenile justice
5555 system before the individual's thirteenth birthday; and
5656 (15) any other member considered appropriate by the
5757 board.
5858 (b) The board shall select one member of the advisory
5959 committee to serve as presiding officer of the advisory committee.
6060 SECTION 4. COMPENSATION. A member of the advisory
6161 committee serves without compensation and is not entitled to
6262 reimbursement for travel expenses.
6363 SECTION 5. APPLICATION OF LAWS GOVERNING ADVISORY
6464 COMMITTEES. The advisory committee is not subject to Chapter 2110,
6565 Government Code.
6666 SECTION 6. DUTIES OF ADVISORY COMMITTEE. The advisory
6767 committee shall:
6868 (1) evaluate the feasibility of raising the minimum
6969 age of a child subject to juvenile court jurisdiction from 10 years
7070 of age to 13 years of age;
7171 (2) identify services currently available for
7272 juveniles between 10 and 13 years of age within the juvenile justice
7373 system; and
7474 (3) develop an implementation plan to raise the
7575 minimum age of a child subject to juvenile court jurisdiction from
7676 10 years of age to 13 years of age, including:
7777 (A) methods for ensuring that juveniles between
7878 10 and 13 years of age who currently receive services through the
7979 juvenile justice system continue to be eligible for and receive
8080 services outside of the juvenile justice system; and
8181 (B) any legislative, administrative, or funding
8282 provisions required to adopt the plan.
8383 SECTION 7. REPORT. Not later than December 1, 2016, the
8484 advisory committee shall submit to the Texas Juvenile Justice
8585 Board, the governor, the lieutenant governor, and appropriate
8686 committees of the legislature a report that contains the advisory
8787 committee's findings and the implementation plan developed under
8888 Section 6 of this Act.
8989 SECTION 8. EXPIRATION DATE. The advisory committee is
9090 abolished and this Act expires December 31, 2016.
9191 SECTION 9. EFFECTIVE DATE. This Act takes effect
9292 immediately if it receives a vote of two-thirds of all the members
9393 elected to each house, as provided by Section 39, Article III, Texas
9494 Constitution. If this Act does not receive the vote necessary for
9595 immediate effect, this Act takes effect September 1, 2015.
