97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Title 2, Agriculture Code, is amended by adding
119 Chapter 23 to read as follows:
1210 CHAPTER 23. COMMUNITY DEVELOPMENT MATCHING GRANT PROGRAM FOR RURAL
1311 AND SMALL COMMUNITIES
1412 Sec. 23.001. DEFINITION. In this chapter, "program" means
1513 the community development matching grant program established under
1614 this chapter.
1715 Sec. 23.002. COMMUNITY DEVELOPMENT MATCHING GRANT PROGRAM.
1816 (a) Subject to the availability of federal and state funds, the
1917 department shall create a community development matching grant
2018 program to foster community and economic development in certain
2119 municipalities and counties.
2220 (b) The department shall award matching grants under the
2321 program to assist in the financing of:
2422 (1) trade-related initiatives and programs, as
2523 determined by the commissioner, that will assist farmers, ranchers,
2624 and the equine industry in eligible municipalities or counties to
2725 develop and export their produce, products, and services to
2826 international markets;
2927 (2) community development projects, including basic
3028 infrastructure projects such as water or wastewater facilities and
3129 planning, street improvements, and drainage;
3230 (3) capacity-building projects relating to local
3331 public facility and housing planning activities;
3432 (4) renewable energy projects to help participating
3533 rural communities reduce energy costs for water and wastewater
3634 treatment facilities;
3735 (5) restoration projects for water or wastewater
3836 infrastructure based on urgent need, if the infrastructure poses an
3937 imminent threat to life or health;
4038 (6) economic development projects to create or retain
4139 permanent employment opportunities;
4240 (7) economic development projects to support economic
4341 and management development activities at the county level;
4442 (8) environmental projects that provide assistance to
4543 small communities for solving water or wastewater problems using
4644 self-help methods; and
4745 (9) other community development projects as
4846 determined by the department with the assistance of the Texas Rural
4947 Health and Economic Development Advisory Council.
5048 Sec. 23.003. ELIGIBLE ENTITIES. A municipality or county
5149 is eligible for a matching grant under this chapter if the
5250 municipality or county is:
5351 (1) a nonentitlement area, as defined by 42 U.S.C.
5452 Section 5302(a)(7), under the federal community development block
5553 grant nonentitlement program; and
5654 (2) in good standing with the department and with the
5755 United States Department of Housing and Urban Development.
5856 Sec. 23.004. APPLICATIONS. Eligible municipalities or
5957 counties may submit a single-jurisdiction application or a
6058 multi-jurisdiction application for a matching grant under the
6159 program for a community development project. An application must
6260 include a description of the project proposal.
6361 Sec. 23.005. PREFERENCE FOR MULTI-JURISDICTION
6462 APPLICATIONS. (a) In awarding a matching grant under the program,
6563 the department shall give preference to an application submitted
6664 under the program by two or more eligible municipalities or
6765 counties if the application shows that the proposed community
6866 development project will mutually benefit the residents of the
6967 communities applying for the funds.
7068 (b) A multi-jurisdiction application solely for
7169 administrative convenience may not be accepted by the department.
7270 (c) A municipality or county that has submitted a
7371 multi-jurisdiction application may not submit a
7472 single-jurisdiction application for a matching grant for the same
7573 project for which the multi-jurisdiction application was
7674 submitted.
7775 (d) If a matching grant is awarded under this program, one
7876 of the municipalities or counties participating under a
7977 multi-jurisdiction application shall be primarily accountable to
8078 the department for financial compliance and performance
8179 requirements under the program. All municipalities and counties
8280 applying under a multi-jurisdiction application must meet
8381 application threshold requirements.
8482 Sec. 23.006. RULES. (a) The department by rule shall set
8583 criteria for matching grant requirements and participation under
8684 the program.
8785 (b) The department shall adopt rules necessary to implement
8886 this chapter.
8987 Sec. 23.007. EXPIRATION PROVISION. This chapter expires
9088 September 1, 2021.
9189 SECTION 2. This Act takes effect immediately if it receives
9290 a vote of two-thirds of all the members elected to each house, as
9391 provided by Section 39, Article III, Texas Constitution. If this
9492 Act does not receive the vote necessary for immediate effect, this
9593 Act takes effect September 1, 2015.
