| 16 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 17 | 17 | | SECTION 1. Section 1.01, Chapter 385, Acts of the 78th |
|---|
| 18 | 18 | | Legislature, Regular Session, 2003, is amended by adding |
|---|
| 19 | 19 | | Subdivision (4-b) to read as follows: |
|---|
| 20 | 20 | | (4-b) "Council" means the council established under |
|---|
| 21 | 21 | | Section 1B.01 of this Act. |
|---|
| 22 | 22 | | SECTION 2. Chapter 385, Acts of the 78th Legislature, |
|---|
| 23 | 23 | | Regular Session, 2003, is amended by adding Article IB to read as |
|---|
| 24 | 24 | | follows: |
|---|
| 25 | 25 | | ARTICLE IB. INFRASTRUCTURE IMPROVEMENT COUNCIL |
|---|
| 26 | 26 | | Sec. 1B.01. INFRASTRUCTURE IMPROVEMENT COUNCIL. (a) The |
|---|
| 27 | 27 | | board shall establish an infrastructure improvement council in |
|---|
| 28 | 28 | | connection with the implementation of infrastructure improvement |
|---|
| 29 | 29 | | projects within the authority's territory. |
|---|
| 30 | 30 | | (b) The board shall set, according to a formula determined |
|---|
| 31 | 31 | | by the board, an annual voluntary assessment. Revenue from the |
|---|
| 32 | 32 | | assessment imposed under this subsection shall be deposited to the |
|---|
| 33 | 33 | | credit of an infrastructure improvement fund to be administered by |
|---|
| 34 | 34 | | the council. After the board sets the formula used to determine the |
|---|
| 35 | 35 | | assessment, the assessment may be modified only by the council. |
|---|
| 36 | 36 | | (c) A member of the conference that pays the voluntary |
|---|
| 37 | 37 | | assessment under Subsection (b) shall appoint a representative to |
|---|
| 38 | 38 | | serve as a member of the council. |
|---|
| 39 | 39 | | (d) The council may apply for financial assistance under |
|---|
| 40 | 40 | | Subchapters G and H, Chapter 15, Water Code, and may implement |
|---|
| 41 | 41 | | infrastructure improvement projects approved by the council under |
|---|
| 42 | 42 | | this article. |
|---|
| 43 | 43 | | (e) The council shall study the viability of each |
|---|
| 44 | 44 | | infrastructure improvement project requested by council members to |
|---|
| 45 | 45 | | determine whether an infrastructure improvement project is |
|---|
| 46 | 46 | | eligible to receive financial assistance from the council. |
|---|
| 47 | 47 | | (f) Only members of the council are eligible to receive |
|---|
| 48 | 48 | | financial assistance from the council for infrastructure |
|---|
| 49 | 49 | | improvement projects under this article. |
|---|
| 50 | 50 | | (g) The council shall establish procedures to govern the |
|---|
| 51 | 51 | | council. |
|---|
| 52 | 52 | | (h) The council may: |
|---|
| 53 | 53 | | (1) hire employees to implement this section; and |
|---|
| 54 | 54 | | (2) engage in infrastructure improvement projects |
|---|
| 55 | 55 | | without board approval. |
|---|
