6	6	AN ACT
7	7	relating to physical activity and physical education requirements
8	8	in public schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 28.002(l), Education Code, is amended to
11	11	read as follows:
12	12	(l) A school district shall require a student enrolled in
13	13	full-day prekindergarten, in kindergarten, or in a grade level
14	14	below grade six to participate in moderate or vigorous daily
15	15	physical activity for at least 30 minutes throughout the school
16	16	year as part of the district's physical education curriculum or
17	17	through structured activity during a school campus's daily
18	18	recess. To the extent practicable, a school district shall require
19	19	a student enrolled in prekindergarten on less than a full-day basis
20	20	to participate in the same type and amount of physical activity as a
21	21	student enrolled in full-day prekindergarten. A school district
22	22	shall require students enrolled in grade levels six, seven, and
23	23	eight to participate in moderate or vigorous daily physical
24	24	activity for at least 30 minutes for six [at least four] semesters
25	25	during those grade levels as part of the district's physical
26	26	education curriculum. If a school district determines, for any
27	27	particular grade level below grade six, that requiring moderate or
28	28	vigorous daily physical activity is impractical due to scheduling
29	29	concerns or other factors, the district may as an alternative
30	30	require a student in that grade level to participate in moderate or
31	31	vigorous physical activity for at least 135 minutes during each
32	32	school week. Additionally, a school district may as an alternative
33	33	require a student enrolled in a grade level for which the district
34	34	uses block scheduling to participate in moderate or vigorous
35	35	physical activity for at least 225 minutes during each period of two
36	36	school weeks. A school district must provide for an exemption for:
37	37	(1) any student who is unable to participate in the
38	38	required physical activity because of illness or disability; and
39	39	(2) a middle school or junior high school student who
40	40	participates in an extracurricular activity with a moderate or
41	41	vigorous physical activity component that is considered a
42	42	structured activity under rules adopted by the commissioner.
43	43	SECTION 2. Section 28.025(b-1), Education Code, is amended
44	44	to read as follows:
45	45	(b-1) The State Board of Education by rule shall require
46	46	that the curriculum requirements for the foundation high school
47	47	program under Subsection (a) include a requirement that students
48	48	successfully complete:
49	49	(1) four credits in English language arts under
50	50	Section 28.002(a)(1)(A), including one credit in English I, one
51	51	credit in English II, one credit in English III, and one credit in
52	52	an advanced English course authorized under Subsection (b-2);
53	53	(2) three credits in mathematics under Section
54	54	28.002(a)(1)(B), including one credit in Algebra I, one credit in
55	55	geometry, and one credit in any advanced mathematics course
56	56	authorized under Subsection (b-2);
57	57	(3) three credits in science under Section
58	58	28.002(a)(1)(C), including one credit in biology, one credit in any
59	59	advanced science course authorized under Subsection (b-2), and one
60	60	credit in integrated physics and chemistry or in an additional
61	61	advanced science course authorized under Subsection (b-2);
62	62	(4) three credits in social studies under Section
63	63	28.002(a)(1)(D), including one credit in United States history, at
64	64	least one-half credit in government and at least one-half credit in
65	65	economics, and one credit in world geography or world history;
66	66	(5) except as provided under Subsections (b-12),
67	67	(b-13), and (b-14), two credits in the same language in a language
68	68	other than English under Section 28.002(a)(2)(A);
69	69	(6) 4-1/2 [five] elective credits;
70	70	(7) one credit in fine arts under Section
71	71	28.002(a)(2)(D); and
72	72	(8) except as provided by Subsection (b-11), 1-1/2
73	73	credits [one credit] in physical education under Section
74	74	28.002(a)(2)(C).
75	75	SECTION 3. Section 28.002(l), Education Code, as amended by
76	76	this Act, applies only to students entering the sixth grade during
77	77	the 2015-2016 school year or a later school year. For students
78	78	entering a grade above sixth grade during the 2015-2016 school
79	79	year, Section 28.002(l), Education Code, as that section existed
80	80	before amendment by this Act, applies, and that section is
81	81	continued in effect for that purpose.
82	82	SECTION 4. Section 28.025(b-1), Education Code, as amended
83	83	by this Act, applies only to students entering the ninth grade
84	84	during the 2015-2016 school year or a later school year. For
85	85	students entering a grade above ninth grade during the 2015-2016
86	86	school year, Section 28.025(b-1), Education Code, as that section
87	87	existed before amendment by this Act, applies, and that section is
88	88	continued in effect for that purpose.
89	89	SECTION 5. This Act takes effect immediately if it receives
90	90	a vote of two-thirds of all the members elected to each house, as
91	91	provided by Section 39, Article III, Texas Constitution. If this
92	92	Act does not receive the vote necessary for immediate effect, this
93	93	Act takes effect September 1, 2015.
