| 7 | 7 | | relating to prohibiting the implementation in this state of any |

| 8 | 8 | | federal greenhouse gas emissions regulatory program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 382, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 382.005 to read as follows: |
|---|
| 12 | 12 | | Sec. 382.005. PROHIBITION ON IMPLEMENTATION OF GREENHOUSE |
|---|
| 13 | 13 | | GAS EMISSIONS REGULATORY PROGRAMS. (a) In this section: |
|---|
| 14 | 14 | | (1) "Greenhouse gas" includes: |
|---|
| 15 | 15 | | (A) carbon dioxide; |
|---|
| 16 | 16 | | (B) methane; |
|---|
| 17 | 17 | | (C) nitrous oxide; |
|---|
| 18 | 18 | | (D) hydrofluorocarbons; |
|---|
| 19 | 19 | | (E) perfluorocarbons; |
|---|
| 20 | 20 | | (F) sulfur hexafluoride; and |
|---|
| 21 | 21 | | (G) other gases or substances incorporated into a |
|---|
| 22 | 22 | | regional or federal greenhouse gas emissions regulatory program. |
|---|
| 23 | 23 | | (2) "Greenhouse gas emissions regulatory program" |
|---|
| 24 | 24 | | means an arrangement under which a greenhouse gas emissions source |
|---|
| 25 | 25 | | is required to account for or report greenhouse gas emissions. The |
|---|
| 26 | 26 | | term includes a market-based compliance mechanism. |
|---|
| 27 | 27 | | (3) "Market-based compliance mechanism" means a |
|---|
| 28 | 28 | | system of market-based declining annual aggregate greenhouse gas |
|---|
| 29 | 29 | | emissions limits, including a greenhouse gas emissions exchange, |
|---|
| 30 | 30 | | banking, credit, or other similar transaction. |
|---|
| 31 | 31 | | (b) A state agency, including the commission, may not |
|---|
| 32 | 32 | | implement or adopt rules that would implement a greenhouse gas |
|---|
| 33 | 33 | | emissions regulatory program required by federal statute or agency |
|---|
| 34 | 34 | | rule. |
|---|
| 35 | 35 | | (c) A state employee may not participate on a board, |
|---|
| 36 | 36 | | committee, or related entity, or in a study, of a national |
|---|
| 37 | 37 | | organization assigned to recommend provisions to implement a |
|---|
| 38 | 38 | | federal greenhouse gas emissions regulatory program. |
|---|
| 39 | 39 | | (d) This section does not apply to voluntary actions taken |
|---|
| 40 | 40 | | to reduce greenhouse gas emissions. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2015. |
