| 12 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 9 | | SECTION 1. Section 396.022(a), Transportation Code, is |
|---|
| 14 | 10 | | amended to read as follows: |
|---|
| 15 | 11 | | (a) A junkyard or an automotive wrecking and salvage yard |
|---|
| 16 | 12 | | may not be located: |
|---|
| 17 | 13 | | (1) within 50 feet of the right-of-way of a public |
|---|
| 18 | 14 | | street or[,] state highway;[,] or |
|---|
| 19 | 15 | | (2) within 50 feet of the nearest property line of a |
|---|
| 20 | 16 | | residence. |
|---|
| 21 | 17 | | SECTION 2. Section 396.022(a), Transportation Code, as |
|---|
| 22 | 18 | | amended by this Act, applies only to a junkyard or an automotive |
|---|
| 23 | 19 | | wrecking and salvage yard that begins operating on or after the |
|---|
| 24 | 20 | | effective date of this Act. A junkyard or an automotive wrecking |
|---|
| 25 | 21 | | and salvage yard operating before the effective date of this Act is |
|---|
| 26 | 22 | | governed by the law applicable immediately before the effective |
|---|
| 27 | 23 | | date of this Act, and that law is continued in effect for that |
|---|
| 28 | 24 | | purpose. |

| 29 | 25 | | SECTION 3. This Act takes effect September 1, 2015. |
