66 AN ACT
77 relating to the territory of the Hays Trinity Groundwater
88 Conservation District; authorizing the regulation of certain wells
99 for the production of groundwater.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 8843, Special District
1212 Local Laws Code, is amended by adding Section 8843.0045 to read as
1313 follows:
1414 Sec. 8843.0045. SHARED TERRITORY; JURISDICTION. (a) The
1515 territory of the district includes any territory that is:
1616 (1) inside the boundaries of the Edwards Aquifer
1717 Authority; and
1818 (2) in Hays County.
1919 (b) The Edwards Aquifer Authority has jurisdiction over any
2020 well that is drilled to produce water from the Edwards Aquifer in
2121 the shared territory described by Subsection (a).
2222 (c) The district has jurisdiction over any well that is
2323 drilled to produce water from any aquifer other than the Edwards
2424 Aquifer in the shared territory described by Subsection (a).
2525 (d) The district has jurisdiction over any well that is
2626 drilled to produce water from the Edwards Aquifer or any other
2727 aquifer in the territory described by Section 8843.004.
2828 SECTION 2. As soon as practicable after the effective date
2929 of this Act, and in conformance with the requirements of Section
3030 8843.052, Special District Local Laws Code, the board of directors
3131 of the Hays Trinity Groundwater Conservation District shall revise
3232 the single-member districts as the board considers appropriate to
3333 reflect the changes in territory made by Section 8843.0045, Special
3434 District Local Laws Code, as added by this Act.
3535 SECTION 3. (a) The legislature validates and confirms all
3636 acts and proceedings of the board of directors of the Hays Trinity
3737 Groundwater Conservation District that were taken before the
3838 effective date of this Act.
3939 (b) Subsection (a) of this section does not apply to any
4040 matter that on the effective date of this Act:
4141 (1) is involved in litigation if the litigation
4242 ultimately results in the matter being held invalid by a final
4343 judgment of a court; or
4444 (2) has been held invalid by a final judgment of a
4545 court.
4646 SECTION 4. (a) The legal notice of the intention to
4747 introduce this Act, setting forth the general substance of this
4848 Act, has been published as provided by law, and the notice and a
4949 copy of this Act have been furnished to all persons, agencies,
5050 officials, or entities to which they are required to be furnished
5151 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5252 Government Code.
5353 (b) The governor, one of the required recipients, has
5454 submitted the notice and Act to the Texas Commission on
5555 Environmental Quality.
5656 (c) The Texas Commission on Environmental Quality has filed
5757 its recommendations relating to this Act with the governor, the
5858 lieutenant governor, and the speaker of the house of
5959 representatives within the required time.
6060 (d) All requirements of the constitution and laws of this
6161 state and the rules and procedures of the legislature with respect
6262 to the notice, introduction, and passage of this Act are fulfilled
6363 and accomplished.
6464 SECTION 5. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2015.
