95 relating to certain required reports, plans, and other documents
106 prepared by state agencies and institutions of higher education.
117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
128 SECTION 1. Section 32.034(e), Education Code, is amended to
139 read as follows:
1410 (e) The board of directors shall:
1511 (1) employ a director for the center; and
1612 (2) establish priorities for the center's activities[;
1713 and
1814 [(3) report annually on the operation, projects, and
1915 fiscal affairs of the center to the State Board of Education and the
2016 membership of the center].
2117 SECTION 2. Section 39.263(c), Education Code, is amended to
2218 read as follows:
2319 (c) The commissioner shall select annually schools and
2420 districts qualified to receive successful school awards for their
2521 performance [and report the selections to the governor and the
2622 State Board of Education].
2723 SECTION 3. Section 51.752(h), Education Code, is amended to
2824 read as follows:
2925 (h) If the legislature fails to appropriate funds for the
3026 operation of the Educational Economic Policy Center, the
3127 Legislative Budget Board shall perform the duties of the committee
3228 under this subchapter. [The board shall make the annual reports
3329 required by Subsection (g) to the presiding officers of the
3430 standing committees of the senate and the house of representatives
3531 with primary jurisdiction over the public school system.]
3632 SECTION 4. Section 61.0762(a), Education Code, is amended
3733 to read as follows:
3834 (a) To [implement the college readiness and success
3935 strategic action plan adopted under Section 61.0761 and to] enhance
4036 the success of students at institutions of higher education, the
4137 board by rule shall:
4238 (1) develop higher education bridge programs in the
4339 subject areas of mathematics, science, social science, or English
4440 language arts to increase student success by reducing the need for
4541 developmental education;
4642 (2) develop incentive programs for institutions of
4743 higher education that implement research-based, innovative
4844 developmental education initiatives;
4945 (3) develop a pilot program to award grants to
5046 institutions of higher education for intensive programs designed to
5147 address the needs of students at risk of dropping out of college;
5248 (4) develop professional development programs for
5349 faculty of institutions of higher education on college readiness
5450 standards and the implications of such standards on instruction;
5551 and
5652 (5) develop other programs as determined by the board
5753 that support the participation and success goals in "Closing the
5854 Gaps," the state's master plan for higher education.
5955 SECTION 5. Section 88.526(a), Education Code, is amended to
6056 read as follows:
6157 (a) The director shall prepare an annual report on equine
6258 research funded under this subchapter. The director shall
6359 distribute the report to [the Texas Racing Commission and] members
6460 of the Texas horse racing industry. The director shall make copies
6561 of the report available to interested parties.
6662 SECTION 6. Section 72.084, Government Code, is amended to
6763 read as follows:
6864 Sec. 72.084. COURT OF APPEALS. Each month, a [A] court of
6965 appeals shall [annually] report to the office:
7066 (1) the number of cases filed with the court during the
7167 reporting month [year];
7268 (2) the number of cases disposed of by the court during
7369 the reporting month [year];
7470 (3) for active cases on the docket of the court on the
7571 reporting date, the average number of days from the date of
7672 submission of the case to the court until the reporting date; and
7773 (4) for each case disposed of during the reporting
7874 month [year] by the court, the number of days from the date of
7975 submission of the case to the court until the date of disposition of
8076 the case by the court.
8177 SECTION 7. Section 531.02111(e), Government Code, is
8278 amended to read as follows:
8379 (e) Not later than December 1 of each even-numbered year,
8480 the commission shall submit the report to the governor, the
8581 lieutenant governor, the speaker of the house of representatives,
8682 the presiding officer of each standing committee of the senate and
8783 house of representatives having jurisdiction over health and human
8884 services issues, and the state auditor[, and the comptroller].
8985 SECTION 8. Section 531.02112(c), Government Code, is
9086 amended to read as follows:
9187 (c) The commission shall submit the report to the governor,
9288 legislature, and state auditor[, and comptroller].
9389 SECTION 9. Section 531.055(a), Government Code, as amended
9490 by S.B. 219, Acts of the 84th Legislature, Regular Session, 2015, is
9591 amended to read as follows:
9692 (a) Each health and human services agency, the Texas
9793 Correctional Office on Offenders with Medical or Mental
9894 Impairments, the Texas Department of Criminal Justice, the Texas
9995 Department of Housing and Community Affairs, [the Texas Education
10096 Agency,] the Texas Workforce Commission, and the Texas Juvenile
10197 Justice Department shall enter into a joint memorandum of
10298 understanding to promote a system of local-level interagency
10399 staffing groups to coordinate services for persons needing
104100 multiagency services.
105101 SECTION 10. Section 614.072(f), Government Code, is amended
106102 to read as follows:
107103 (f) The director shall prepare an annual written report on
108104 the activity, status, and effectiveness of the fund and shall
109105 submit the report to the lieutenant governor and[,] the speaker of
110106 the house of representatives[, and the comptroller] before
111107 September 1 of each year.
112108 SECTION 11. Section 772.009, Government Code, is amended by
113109 amending Subsection (g) and adding Subsection (g-1) to read as
114110 follows:
115111 (g) Each state agency other than an institution of higher
116112 education shall file an annual report with the grant writing team
117113 concerning the agency's efforts to acquire [in acquiring] available
118114 discretionary federal funds during the preceding state fiscal
119115 year. The grant writing team shall establish guidelines for
120116 information included in the annual report required by this
121117 subsection [section].
122118 (g-1) The grant writing team shall:
123119 (1) evaluate the effectiveness of each agency in
124120 acquiring discretionary federal funds during the preceding state
125121 fiscal year;
126122 (2) [and shall] report the findings of the evaluation
127123 to the governor and the Legislative Budget Board; and
128124 (3) publish the report on the office of the governor's
129125 Internet website.
130126 SECTION 12. Section 2054.102, Government Code, is amended
131127 by amending Subsection (a) and adding Subsections (a-1), (a-2),
132128 (a-3), and (a-4) to read as follows:
133129 (a) The Legislative Budget Board may specify procedures for
134130 [the] submission, review, approval, and disapproval of biennial
135131 operating plans and amendments, including procedures for review or
136132 reconsideration of the Legislative Budget Board's disapproval of a
137133 biennial operating plan or biennial operating plan amendment. The
138134 Legislative Budget Board shall review and approve or disapprove the
139135 biennial operating plan for a state fiscal biennium on or before [or
140136 biennial operating plan amendment not later than] the 60th day
141137 after the last day of the regular legislative session held during
142138 the calendar year during which that state fiscal biennium begins
143139 [date the plan or amendment to the plan is submitted].
144140 (a-1) If an amendment to a biennial operating plan is
145141 submitted to the Legislative Budget Board on a date that falls
146142 during the period beginning September 1 of an even-numbered year
147143 and ending the last day of the following regular legislative
148144 session, the Legislative Budget Board shall review and approve or
149145 disapprove the amendment on or before the 60th day after the last
150146 day of that regular legislative session.
151147 (a-2) If an [The plan or] amendment to a biennial operating
152148 [the] plan is submitted to the Legislative Budget Board on a date
153149 that falls outside of the period described by Subsection (a-1), the
154150 Legislative Budget Board shall review and approve or disapprove the
155151 amendment on or before the 60th day after the date the amendment is
156152 submitted.
157153 (a-3) The Legislative Budget Board may extend the deadline
158154 for the Legislative Budget Board's action on an amendment to a
159155 biennial operating plan by the number of days the review of the
160156 amendment is delayed while board staff waits for the submission of
161157 additional information regarding the amendment requested by the
162158 staff as necessary for the completion of the review.
163159 (a-4) An amendment to a biennial operating plan is
164160 considered to be approved [on the 61st day after the date the plan
165161 or amendment is submitted] if the Legislative Budget Board does not
166162 disapprove the [plan or] amendment before the later of:
167163 (1) the day following the last day of the period for
168164 approval or disapproval of the amendment as provided by Subsection
169165 (a-1) or (a-2), as applicable; or
170166 (2) the day following the last day of the period for
171167 approval or disapproval of the amendment as extended under
172168 Subsection (a-3) [that date].
173169 SECTION 13. Section 2056.002(d), Government Code, is
174170 amended to read as follows:
175171 (d) A state agency shall send two copies of each plan to both
176172 the Legislative Reference Library and the state publications
177173 clearinghouse of the Texas State Library and one copy each to:
178174 (1) the governor;
179175 (2) the lieutenant governor;
180176 (3) the speaker of the house of representatives;
181177 (4) the Legislative Budget Board;
182178 (5) the Sunset Advisory Commission;
183179 (6) the state auditor; and
184180 (7) [the comptroller; and
185181 [(8)] the Department of Information Resources.
186182 SECTION 14. Section 2056.009(b), Government Code, is
187183 amended to read as follows:
188184 (b) The state plan shall be sent to the governor, lieutenant
189185 governor, [comptroller,] and each member of the legislature not
190186 later than the seventh working day of each regular session of the
191187 legislature.
192188 SECTION 15. Section 2165.055, Government Code, as amended
193189 by Chapters 1153 (S.B. 211) and 1312 (S.B. 59), Acts of the 83rd
194190 Legislature, Regular Session, 2013, is reenacted and amended to
195191 read as follows:
196192 Sec. 2165.055. REPORT ABOUT IMPROVEMENTS AND REPAIRS. Not
197193 later than December 1 of each even-numbered year, the commission
198194 [on July 1 of each even-numbered year] shall [electronically submit
199195 a] report to the governor[, lieutenant governor, speaker of the
200196 house of representatives, comptroller, and Legislative Budget
201197 Board on]:
202198 (1) all improvements and repairs that have been made,
203199 with an itemized account of receipts and expenditures; and
204200 (2) the condition of all property under its control,
205201 with an estimate of needed improvements and repairs.
206202 SECTION 16. Section 2165.1061(h), Government Code, is
207203 amended to read as follows:
208204 (h) In addition to the requirements of Subsection (f), [not
209205 later than July 1 of each even-numbered year,] the commission shall
210206 complete a study on the amount of each state agency's
211207 administrative office space in Travis County to identify locations
212208 that exceed the space limitations prescribed by Section 2165.104(c)
213209 and include the findings of the study in the commission's master
214210 facilities plan required under Section 2166.102. The findings
215211 shall include:
216212 (1) the location of office space that exceeds the
217213 space limitations prescribed by Section 2165.104(c);
218214 (2) the amount of excess space;
219215 (3) the cost of the excess space;
220216 (4) the expiration dates of any leases covering the
221217 excess space;
222218 (5) the amount of exempt and nonexempt space under
223219 Section 2165.104(c); and
224220 (6) recommendations for the most cost-effective
225221 method by which a state agency could comply with the requirements of
226222 Section 2165.104(c), including recommendations that identify the
227223 amount and cost of office space that could be reduced or eliminated,
228224 state the moving costs and expenses associated with reductions in
229225 space, and state the earliest date by which the space reductions
230226 could be feasibly achieved.
231227 SECTION 17. Section 2166.101(d), Government Code, as
232228 amended by Chapters 1153 (S.B. 211) and 1312 (S.B. 59), Acts of the
233229 83rd Legislature, Regular Session, 2013, is reenacted and amended
234230 to read as follows:
235231 (d) The commission shall summarize its findings on the
236232 status of state-owned buildings and current information on
237233 construction costs and include the summary in the commission's
238234 master facilities plan required under Section 2166.102 [in an
239235 electronically submitted report to the governor, lieutenant
240236 governor, speaker of the house of representatives, comptroller, and
241237 Legislative Budget Board not later than July 1 of each
242238 even-numbered year].
243239 SECTION 18. Section 2166.102(b), Government Code, is
244240 amended to read as follows:
245241 (b) The commission shall maintain a six-year capital
246242 planning cycle and shall electronically submit a master facilities
247243 plan with the governor, lieutenant governor, speaker of the house
248244 of representatives, Legislative Budget Board, and comptroller not
249245 later than December 1 [before July 1] of each even-numbered year.
250246 SECTION 19. Section 2166.103(b), Government Code, as
251247 amended by Chapters 1153 (S.B. 211) and 1312 (S.B. 59), Acts of the
252248 83rd Legislature, Regular Session, 2013, is reenacted and amended
253249 to read as follows:
254250 (b) The [Not later than July 1 of each even-numbered year,]
255251 commission shall identify [electronically submit to the governor,
256252 the lieutenant governor, the speaker of the house of
257253 representatives, the comptroller, and the Legislative Budget Board
258254 a report identifying] counties in which more than 50,000 square
259255 feet of usable office space is needed and make recommendations for
260256 meeting that need. The commission may recommend leasing or
261257 purchasing and renovating one or more existing buildings or
262258 constructing one or more buildings. The commission shall include
263259 the commission's findings and recommendations in the commission's
264260 master facilities plan required under Section 2166.102.
265261 SECTION 20. Section 2205.041, Government Code, is amended
266262 to read as follows:
267263 Sec. 2205.041. AIRCRAFT USE FORM. (a) The Texas Department
268264 of Transportation [Legislative Budget Board, in cooperation with
269265 the board,] shall prescribe:
270266 (1) an annual aircraft use form for gathering
271267 information about the use of state-operated aircraft, including the
272268 extent to which and the methods by which the goal provided by
273269 Section 2205.031(b) is being met; and
274270 (2) procedures for each state agency that operates an
275271 aircraft for sending the form to the department [board and the
276272 Legislative Budget Board].
277273 (b) The aircraft use form must request the following
278274 information about each aircraft a state agency operates:
279275 (1) a description of the aircraft;
280276 (2) the date purchased or leased and the purchase
281277 price or lease cost;
282278 (3) the number of annual hours flown;
283279 (4) the annual operating costs;
284280 (5) the number of flights and the destinations;
285281 (6) the travel logs prepared under Section 2205.039;
286282 and
287283 (7) any other information the Texas Department of
288284 Transportation [Legislative Budget Board] requires to document the
289285 proper or cost-efficient use of the aircraft.
290286 SECTION 21. The following provisions are repealed:
291287 (1) Section 51.752(g), Education Code;
292288 (2) Section 61.0761, Education Code;
293289 (3) Section 109.75(c), Education Code;
294290 (4) Section 761.005, Government Code;
295291 (5) Section 2166.409, Government Code;
296292 (6) Section 372.004, Health and Safety Code; and
297293 (7) Section 162.501(c), Tax Code.
298294 SECTION 22. This Act takes effect September 1, 2015.
