66 AN ACT
77 relating to improving the accountability of local workforce
88 development boards and consumer information regarding job training
99 programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 302.048, Labor Code, is amended by
1212 amending Subsections (c) and (d) and adding Subsections (d-1) and
1313 (g) to read as follows:
1414 (c) Based on the criteria prescribed under this section, the
1515 commission shall develop annual performance measures to be used by
1616 the commission to evaluate each local workforce development board.
1717 (d) The commission shall post on its Internet website an
1818 annual report of the results of the commission's most recent
1919 evaluation of each local workforce development board. The report
2020 must be posted:
2121 (1) not later than the end of the second quarter
2222 following the 12-month period covered by the report, as determined
2323 by the commission for purposes of this subdivision; and
2424 (2) [on the commission's Internet website] in a format
2525 that:
2626 (A) is readily accessible to and understandable
2727 by a member of the public; and
2828 (B) includes any necessary explanatory
2929 information.
3030 (d-1) The annual report posted by the commission on its
3131 Internet website under Subsection (d) must include the following
3232 information regarding each local workforce development board:
3333 (1) a comparison of the board's result on each annual
3434 performance measure established by the commission with the
3535 applicable commission-established target for that measure; and
3636 (2) a summary of material findings from the most
3737 recent financial monitoring review conducted by the commission.
3838 (g) Each local workforce development board shall include in
3939 a prominent location on its Internet website a link to the annual
4040 report required to be posted on the commission's website under
4141 Subsection (d).
4242 SECTION 2. Subchapter C, Chapter 302, Labor Code, is
4343 amended by adding Section 302.049 to read as follows:
4444 Sec. 302.049. JOB TRAINING PROGRAM DATABASE. (a) To
4545 facilitate a consumer's informed selection among job training
4646 programs, the commission shall:
4747 (1) include in its searchable database of job training
4848 programs that are currently approved by one or more local workforce
4949 development boards and certified by the commission, annual
5050 performance outcomes for each program, including the program's
5151 completion rate, post-program completion entered employment rate,
5252 and average starting hourly wages at placement, or, if hourly wages
5353 are not appropriate, post-program completion average quarterly
5454 wages; and
5555 (2) update the database to reflect the most recent
5656 annual performance outcomes of programs not later than the end of
5757 the second quarter following the 12-month period for which outcomes
5858 were computed, as determined by the commission for purposes of this
5959 subdivision.
6060 (b) Each local workforce development board and certified
6161 provider of a job training program included in the database
6262 described by Subsection (a) shall submit to the commission any data
6363 requested by the commission regarding job training programs as
6464 necessary for the commission to carry out its duties under that
6565 subsection.
6666 (c) The commission may adopt rules as necessary to
6767 administer this section.
6868 SECTION 3. The Texas Workforce Commission shall post on its
6969 Internet website the first annual report required by Section
7070 302.048(d), Labor Code, as amended by this Act, not later than May
7171 1, 2016.
7272 SECTION 4. This Act takes effect September 1, 2015.
