55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of home telemonitoring services under the
88 Medicaid program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 531.02164, Government Code, is amended
1111 by amending Subsection (c) and adding Subsection (f) to read as
1212 follows:
1313 (c) The program required under this section must:
1414 (1) provide that home telemonitoring services are
1515 available only to a person [persons] who:
1616 (A) is [are] diagnosed with a condition for which
1717 the commission makes an evidence-based determination that
1818 monitoring through the use of home telemonitoring services is
1919 cost-effective and feasible [one or more of the following
2020 conditions:
2121 [(i) pregnancy;
2222 [(ii) diabetes;
2323 [(iii) heart disease;
2424 [(iv) cancer;
2525 [(v) chronic obstructive pulmonary
2626 disease;
2727 [(vi) hypertension;
2828 [(vii) congestive heart failure;
2929 [(viii) mental illness or serious emotional
3030 disturbance;
3131 [(ix) asthma;
3232 [(x) myocardial infarction; or
3333 [(xi) stroke]; and
3434 (B) exhibits [exhibit] two or more of the
3535 following risk factors:
3636 (i) two or more hospitalizations in the
3737 prior 12-month period;
3838 (ii) frequent or recurrent emergency room
3939 admissions;
4040 (iii) a documented history of poor
4141 adherence to ordered medication regimens;
4242 (iv) a documented history of falls in the
4343 prior six-month period;
4444 (v) limited or absent informal support
4545 systems;
4646 (vi) living alone or being home alone for
4747 extended periods of time; and
4848 (vii) a documented history of care access
4949 challenges;
5050 (2) ensure that clinical information gathered by a
5151 home health agency or hospital while providing home telemonitoring
5252 services is shared with the patient's physician; and
5353 (3) ensure that the program does not duplicate disease
5454 management program services provided under Section 32.057, Human
5555 Resources Code.
5656 (f) The commission may conduct pilot projects to collect
5757 evidence regarding the effectiveness of using home telemonitoring
5858 services to monitor certain conditions.
5959 SECTION 2. Section 531.02176, Government Code, is amended
6060 to read as follows:
6161 Sec. 531.02176. EXPIRATION OF MEDICAID REIMBURSEMENT FOR
6262 PROVISION OF HOME TELEMONITORING SERVICES. Notwithstanding any
6363 other law, the commission may not reimburse providers under the
6464 Medicaid program for the provision of home telemonitoring services
6565 on or after September 1, 2021 [2015].
6666 SECTION 3. As soon as practicable after the effective date
6767 of this Act, the executive commissioner of the Health and Human
6868 Services Commission shall adopt necessary rules to implement the
6969 changes in law made by this Act.
7070 SECTION 4. If before implementing any provision of this Act
7171 a state agency determines that a waiver or authorization from a
7272 federal agency is necessary for implementation of that provision,
7373 the agency affected by the provision shall request the waiver or
7474 authorization and may delay implementing that provision until the
7575 waiver or authorization is granted.
7676 SECTION 5. This Act takes effect September 1, 2015.
