6	6	AN ACT
7	7	relating to strategic plan goals to address hunger, food,
8	8	nutrition, physical activity, and obesity in this state.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 12, Agriculture Code, is amended by
11	11	adding Section 12.00252 to read as follows:
12	12	Sec. 12.00252. STRATEGIC PLAN GOAL: ADDRESSING HUNGER,
13	13	FOOD, NUTRITION, PHYSICAL ACTIVITY, AND OBESITY. The department
14	14	shall include in the department's strategic plan required under
15	15	Chapter 2056, Government Code, a goal of addressing hunger, food,
16	16	nutrition, physical activity, and obesity in this state by:
17	17	(1) increasing access to nutritious foods by persons
18	18	in this state;
19	19	(2) increasing access to and participation in the
20	20	national free or reduced-price lunch program established under 42
21	21	U.S.C. Section 1751 et seq. by persons eligible for the program;
22	22	(3) strengthening the department's education
23	23	initiatives to increase awareness of food and nutrition programs in
24	24	this state and of the benefits of physical activity by using public
25	25	service announcements; and
26	26	(4) facilitating obesity prevention and diabetes
27	27	awareness initiatives.
28	28	SECTION 2. Section 7.021, Education Code, is amended by
29	29	adding Subsection (d) to read as follows:
30	30	(d) The agency shall include in the agency's strategic plan
31	31	required under Chapter 2056, Government Code, a goal of addressing
32	32	hunger, food, nutrition, physical activity, and obesity in this
33	33	state by:
34	34	(1) increasing access to nutritious foods by persons
35	35	served by the agency;
36	36	(2) increasing access to and participation in the
37	37	national free or reduced-price lunch program established under 42
38	38	U.S.C. Section 1751 et seq. by eligible persons served by the
39	39	agency;
40	40	(3) strengthening the agency's education initiatives
41	41	to increase awareness of food and nutrition programs in this state
42	42	and of the benefits of physical activity by using public service
43	43	announcements; and
44	44	(4) facilitating obesity prevention and diabetes
45	45	awareness initiatives.
46	46	SECTION 3. Section 531.022, Government Code, is amended by
47	47	adding Subsection (f) to read as follows:
48	48	(f) In addition to the goals specified by Subsection (c),
49	49	the plan must include as a goal of the commission, the Department of
50	50	Assistive and Rehabilitative Services, and the Department of State
51	51	Health Services addressing hunger, food, nutrition, physical
52	52	activity, and obesity in this state by:
53	53	(1) increasing access to nutritious foods by persons
54	54	served by the agencies;
55	55	(2) increasing access to and participation in the
56	56	national free or reduced-price lunch program established under 42
57	57	U.S.C. Section 1751 et seq. by eligible persons served by the
58	58	agencies;
59	59	(3) strengthening each agency's education initiatives
60	60	to increase awareness of food and nutrition programs in this state
61	61	and of the benefits of physical activity by using public service
62	62	announcements; and
63	63	(4) facilitating obesity prevention and diabetes
64	64	awareness initiatives.
65	65	SECTION 4. In the first strategic plan under Chapter 2056,
66	66	Government Code, issued after the effective date of this Act:
67	67	(1) the Department of Agriculture shall, using
68	68	existing funds, include in the plan the goals and methods of
69	69	implementing the goals required by Section 12.00252, Agriculture
70	70	Code, as added by this Act; and
71	71	(2) the Texas Education Agency shall, using existing
72	72	funds, include in the plan the goals and methods of implementing the
73	73	goals required by Section 7.021(d), Education Code, as added by
74	74	this Act.
75	75	SECTION 5. The executive commissioner of the Health and
76	76	Human Services Commission shall, using existing funds, include the
77	77	goals and methods of implementing those goals specified by Section
78	78	531.022(f), Government Code, as added by this Act, in the first
79	79	biennial update of the coordinated strategic plan for health and
80	80	human services required by Section 531.022, Government Code, as
81	81	amended by this Act, that is required after the effective date of
82	82	this Act.
83	83	SECTION 6. This Act takes effect September 1, 2015.
