| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Section 11.0641, Education Code, |
|---|
| 12 | 12 | | is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 11.0641. FILING OF FINANCIAL STATEMENT BY TRUSTEE |
|---|
| 14 | 14 | | REQUIRED [FOR CERTAIN SCHOOL DISTRICTS]. |
|---|
| 15 | 15 | | SECTION 2. Subchapter E, Chapter 130, Education Code, is |
|---|
| 16 | 16 | | amended by adding Section 130.0831 to read as follows: |
|---|
| 17 | 17 | | Sec. 130.0831. FILING OF FINANCIAL STATEMENT BY TRUSTEE. |
|---|
| 18 | 18 | | (a) A member of the board of trustees of a junior college district |
|---|
| 19 | 19 | | shall file the financial statement required of state officers under |
|---|
| 20 | 20 | | Subchapter B, Chapter 572, Government Code, with the Texas Ethics |
|---|
| 21 | 21 | | Commission. |
|---|
| 22 | 22 | | (b) Subchapter B, Chapter 572, Government Code: |
|---|
| 23 | 23 | | (1) applies to a trustee of a junior college district |
|---|
| 24 | 24 | | as if the trustee were a state officer; and |
|---|
| 25 | 25 | | (2) governs the contents, timeliness of filing, and |
|---|
| 26 | 26 | | public inspection of a statement filed under this section. |
|---|
| 27 | 27 | | (c) A trustee subject to this section commits an offense if |
|---|
| 28 | 28 | | the trustee fails to file the statement required by this section. An |
|---|
| 29 | 29 | | offense under this section is a Class B misdemeanor. |
|---|
| 30 | 30 | | SECTION 3. Sections 11.064 and 11.0641(a) and (f), |
|---|
| 31 | 31 | | Education Code, are repealed. |
|---|
| 32 | 32 | | SECTION 4. The changes in law made by this Act to Section |
|---|
| 33 | 33 | | 11.0641, Education Code, apply beginning January 1, 2017, to a |
|---|
| 34 | 34 | | trustee who, before the effective date of this Act, was not required |
|---|
| 35 | 35 | | to file a financial statement under Section 11.064 or 11.0641, |
|---|
| 36 | 36 | | Education Code, and such a trustee is not required to include |
|---|
| 37 | 37 | | financial activity occurring before January 1, 2016, in a statement |
|---|
| 38 | 38 | | filed under those sections. A trustee who was required to file a |
|---|
| 39 | 39 | | financial statement under Section 11.064, Education Code, before |
|---|
| 40 | 40 | | its repeal by this Act, shall file a financial statement under |
|---|
| 41 | 41 | | Section 11.0641, Education Code, for financial activity occurring |
|---|
| 42 | 42 | | in 2015. |
|---|
| 43 | 43 | | SECTION 5. Section 130.0831, Education Code, as added by |
|---|
| 44 | 44 | | this Act, applies beginning January 1, 2017. A trustee subject to |
|---|
| 45 | 45 | | Section 130.0831, Education Code, as added by this Act, is not |
|---|
| 46 | 46 | | required to include financial activity occurring before January 1, |
|---|
| 47 | 47 | | 2016, in a financial disclosure statement required under Section |
|---|
| 48 | 48 | | 130.0831, Education Code, as added by this Act. |
|---|
| 49 | 49 | | SECTION 6. This Act takes effect January 1, 2016. |
