55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of a mobile phone by a person occupying a voting
88 station.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.014, Election Code, is amended by
1111 amending Subsections (a) and (b) and adding Subsection (e) to read
1212 as follows:
1313 (a) Except as otherwise provided by this section, a [A]
1414 person may not use a wireless communication device within 100 feet
1515 of a voting station.
1616 (b) A person may not use any mechanical or electronic means
1717 to record [of recording] images or sound within 100 feet of a voting
1818 station.
1919 (e) A person who is occupying a voting station may use the
2020 person's mobile phone to access information that was downloaded,
2121 recorded, or created on the phone before the person entered the
2222 polling place.
2323 SECTION 2. The heading to Section 62.0111, Election Code,
2424 is amended to read as follows:
2525 Sec. 62.0111. NOTICE OF USE [PROHIBITION] OF CERTAIN
2626 DEVICES.
2727 SECTION 3. Section 62.0111(a), Election Code, is amended to
2828 read as follows:
2929 (a) At the discretion of the presiding judge, notice of the
3030 [prohibition of the] use of certain devices under Section 61.014
3131 may be posted at one or more locations in the polling place where it
3232 can be read by persons waiting to vote.
3333 SECTION 4. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2015.
