66 AN ACT
77 relating to restrictions on future employment for state officers
88 and employees who participate in a procurement or contract
99 negotiation on behalf of a state agency; creating an offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 572, Government Code, is
1212 amended by adding Section 572.069 to read as follows:
1313 Sec. 572.069. CERTAIN EMPLOYMENT FOR FORMER STATE OFFICER
1414 OR EMPLOYEE RESTRICTED; CRIMINAL PENALTY. (a) A former state
1515 officer or employee of a state agency who during the period of state
1616 service or employment participated on behalf of a state agency in a
1717 procurement or contract negotiation involving a person may not
1818 accept employment from that person before the second anniversary of
1919 the date the officer's or employee's service or employment with the
2020 state agency ceased.
2121 (b) An individual commits an offense if the individual
2222 violates this section. An offense under this subsection is a Class
2323 A misdemeanor.
2424 SECTION 2. Section 572.069, Government Code, as added by
2525 this Act, applies only to a state officer or employee whose service
2626 or employment with a state agency ceases on or after the effective
2727 date of this Act.
2828 SECTION 3. This Act takes effect September 1, 2015.
